O presente trabalho analisa a proposta de alteração do art. 20 do Código Civil brasileiro pelo Projeto de Lei nº 393/2011, em que discutido o problema da restrição a direitos fundamentais nas relações entre privados pela publicação não autorizada de biografias de personalidades públicas. Compreende-se que a estrutura normativa dos direitos de personalidade estende às relações entre privados o mesmo feixe de posições jurídicas que garante a proteção jusfundamental prevista no art. 5º, inc. IV e X, da CF, sem dispensar o intérprete da necessidade de promover a mesma relação de ponderação exigida aos direitos fundamentais como um todo. Em acréscimo, estuda-se a extensão das restrições externas a direitos fundamentais, evitando-se uma interpretação que possa causar situação de ofensa explícita à previsão constitucional dos artigos 5º e 220 da Constituição Federal. ...

This paper analyses the proposed amendment to art. 20 by the Brazilian Civil Code, which discussed the problem of restriction of fundamental rights in private relations between the publication of unauthorized biographies of public figures. It is understood that the normative structure of personality rights extends to relations between private the same bunch of legal positions that ensures jusfundamental protection provided for in article 5th, inc. IV and X, of the Brazilian Constitution, without missing to the judge the need to promote the same relative weighting required to fundamental rights. In addition, the text analyses the extent of external restrictions to fundamental rights, avoiding an interpretation that may cause offense to the situation of explicit constitutional provisions of articles 5th and 220 of the Federal Constitution. ...
