Considerações sobre a pesquisa em história do direito

Abstract

O objeto da História do Direito e, portanto, os temas que o historiador do Direito deve investigar, como também o método que há de seguir em suas investigações, foram e são matéria de controvérsia. Atualmente, triunfa na historiografia a História social do Direito, quase sempre entendida como história da prática jurídica ou do Direito vivo, tanto em sua gênese como em sua aplicação. Mas uma coisa é a História social do Direito e outra distinta a visão que do Direito pode ter a História social, especialidade que, na pior das hipóteses, arrasta em vários de seus cultores o preconceito de negar valor ao Direito, considerando-o uma ficção da qual não vale a pena ocupar-se. Para a História social do Direito, o Direito é a matéria objeto do conhecimento e o eixo ao redor do qual há de girar a reconstrução do passado. O que não se admite dúvida é a obrigação de fundamentar nossos juízos históricos em fontes objetivas e de identificá-las com precisão para permitir a sua verificação. Nisto consiste, em última instância, a cientificidade do fazer historiográfico.

The object of legal history and, therefore, the topics that the legal historian must investigate, as well as the method that he is to follow in its investigations, were and are subject of controversy. Today, the legal social history triumphs in the historiography field, almost always understood as a history of legal practice or living law, both in its genesis and its application. But one thing is legal social history and another is the view that law can have of social history, a specialty that, in the worst case, drags its researchers to the prejudice of denying value to the law, considering it a fiction of which it is not worth taking up. For the legal social history, law is the subject of knowledge and the axis around which the reconstruction of the past must revolve. What does not admit doubts is the obligation to base our historical judgments on objective sources and to identify them with precision to allow their verification. In this lies the scientificity of the historiographical work.
