O neoliberalismo, o bem-estar social e as competências do município : uma análise da compatibilidade entre os fundamentos adotados pelo STF na ADPF nº 449 e a Constituição de 1988

Abstract

Trata-se de estudo que, utilizando a revisão bibliográfica e jurisprudencial, visa a analisar a correspondência entre os fundamentos de constitucionalidade formal e material proferidos no acórdão da Arguição de Descumprimento de Preceito Fundamental no 449 e a Constituição, no que toca à sua natureza ideológica e à sua compreensão do Domínio Econômico. Para isso, busca-se compreender a natureza, sob a perspectiva da discussão econômica, dos argumentos elencados pelos Ministros, parte a parte. Ademais, busca-se o entendimento da compreensão constitucional de Domínio Econômico e das competências do Município como ente federado, inclusive quanto a esse tocante. Ao final, é possível concluir que, para além do escopo neoliberal de fundamentos do acórdão, a compreensão adotada quanto aos princípios e fundamentos da Constituição Econômica constitui dissonância quanto à natureza da Carta Constitucional de 1988, dada a sua natureza pluralista e tônica voltada ao bem-estar social. Quanto ao Município, ante à natureza limitada da sua autonomia e às competências explicitamente dispostas na Constituição, a compreensão adotada foi coerente com a Carta de 1988, em que pese haja espaço para que o Município intervenha no domínio econômico nos limites constitucionais.

This is a study that, using bibliographical and jurisprudential review, aims to analyze the correspondence between the grounds of formal and material constitutionality pronounced in the judgment of Extraordinary Writ of Non-Compliance with Fundamental Precept No. 449 and the Constitution, regarding its ideological nature and its understanding of Economic Domain. To do so, it seeks to understand the nature, from the perspective of economic discussion, of the arguments listed by the Ministers, part by part. Furthermore, it seeks to understand the constitutional understanding of Economic Domain and the competences of the Municipality as a federated entity, including regarding this matter. In the end, it is possible to conclude that, beyond the neoliberal scope of the grounds of the judgment, the adopted understanding regarding the principles and foundations of the Economic Constitution constitutes dissonance regarding the nature of the 1988 Constitutional Charter, given its pluralistic nature and tone aimed at social welfare. Regarding the Municipality, given the limited nature of its autonomy and the competences explicitly provided for in the Constitution, the adopted understanding was consistent with the 1988 Charter, although there is room for the Municipality to intervene in the economic domain within constitutional limits.
