Dignidade da pessoa humana e ordem econômica na Constituição Federal de 1988: a promoção da dignidade como objetivo da ordem econômica na Constituição Cidadã

Abstract

Analisa a evolução histórica do conceito de dignidade humana, identificando sua presença constante nas ordens constitucionais no pós-Guerra. Delimita o conteúdo mínimo do princípio constitucional da dignidade da pessoa humana. Identifica a regulação da economia por parte do Estado a partir da Constituição Econômica. Relaciona o princípio da dignidade da pessoa humana com a ordem econômica na Constituição Federal do Brasil. Conclui que a Constituição estabelece um programa no qual cabe a promoção da dignidade humana através da ordem econômica. Identifica que o Estado deve atuar na economia para garantir os direitos fundamentais.

It analyzes the historical evolution of the concept of human dignity, identifying its constant presence in the constitutional orders after the War. It delimits the minimum content of the constitutional principle of the dignity of the human person. It identifies the regulation of the economy by the State from the Economic Constitution. It relates the principle of the dignity of the human person to the economic order in the Federal Constitution of Brazil. It concludes that the Constitution establishes a program that should promote human dignity through the economic order. It identifies that the state must act in the economy to guarantee fundamental rights.
