A filiação socioafetiva no direito brasileiro : uma análise sob a perspectiva da jurisprudência do TJRS e do STJ

Abstract

Tendo em vista a notória importância que o afeto tem na construção das entidades familiares, reconhecida inclusive pela Constituição Federal de 1988, e, considerando que o conceito de filiação socioafetiva surgiu de uma construção doutrinária e jurisprudencial, não havendo, portanto, legislação específica que o orienta, pressupôs se, no presente estudo, a existência de diferentes interpretações sobre esse instituto jurídico. A fim de compreender os relevos jurídicos da filiação socioafetiva, em um primeiro momento, realizou-se uma investigação doutrinária para se visualizar, de um modo geral, como ela se situa no ordenamento jurídico brasileiro. Em um momento posterior, investigou-se os principais entendimentos sobre o tema prolatados pelo Tribunal de Justiça do Rio Grande do Sul, para investigar os desdobramentos e divergências existentes sobre o instituto, especificamente no local de realização deste trabalho. Buscou-se realizar, subsequentemente, um quadro geral e comparativo das teses encontradas, bem como das divergências mais prementes na jurisprudência. Por fim, realizou-se uma pesquisa, sob os mesmos parâmetros da anterior, na jurisprudência do Superior Tribunal de Justiça. Objetivou-se obter um quadro mais amplo sobre os entendimentos relegados à filiação socioafetiva, inclusive para compreender se divergências também constam em outras instâncias do Poder Judiciário.

Bearing in mind the notorious importance that affection has in the construction of family entities, which is recognized also by the Federal Constitution of 1988, and considering that a concept of an affection-based filiation arose from a doctrinal and jurisprudential construction, therefore there is no specific legislation that guides it, it was assumed, in the present study, that there might exist different interpretations on that legal institute. In order to understand the legal aspects of the affection-based filiation, at first, a doctrinal investigation was carried out, on the purpose of visualizing, in an overall manner, how the institute is situated in the Brazilian legal system. Posteriorly, the main understandings on the subject emanated from the Rio Grande do Sul State Court of Justice were investigated, in order to identify the developments and divergences existing on this matter, specifically on the location where this study was carried out. Subsequently, it was sought to provide a general and comparative picture of the theses that were found, as well as the most pressing divergences in the jurisprudence. At last, a research was made, under the same parameters as the previous one, in the jurisprudence of the Superior Court of Justice. The intention was to comprehend a broader picture about the understandings regarding the affection-based filiation, and to understand if divergences are also present in other instances of the Judiciary System.
