Os dispute boards à luz dos princípios que regem a administração pública

Abstract

Apesar de não ser um método alternativo de resolução de disputas inédito em contratos com a Administração Pública brasileira, os Comitês de Resolução de Disputas ou Dispute Boards (DBs) foram apresentados à grande parte da comunidade jurídica à partir da edição da nova Lei de Licitações e Contratos Administrativos nº 14.133/21. Nesse sentido, o art. 151 do referido diploma legal é o primeiro dispositivo a apresentar nominalmente os DBs aos contratos administrativos da União, respaldando-se no crescente avanço desse mecanismo no âmbito do direito público. A partir dessa novidade legislativa (que não é tão novidade assim, como explicado oportunamente), o presente Trabalho de Conclusão de Curso investiga a adequabilidade dos Dispute Boards aos princípios que regem a Administração Pública e, por consequência, os contratos administrativos. Para isso, primeiramente, apresenta-se os meios alternativos de resolução de controvérsias consagrados na nova Lei de Licitações e Contratos Administrativos e as diferenças que eles exibem em relação aos DBs. Ato contínuo, apresenta-se os diferentes tipos de Dispute Boards, bem como realiza-se breve apanhado histórico sobre seu desenvolvimento. Após o deslinde sobre o que são e como funcionam, utilizando-se de método dedutivo por meio de pesquisa bibliográfica, analisa-se a compatibilidade e as controvérsias do referido método relativamente aos princípios que regem a Administração Pública.

Despite not being a new alternative dispute resolution method in contracts with the Brazilian Public Administration, the Dispute Resolution Boards or Dispute Boards (DBs) were introduced to the majority of the legal community with the publication of the new Law on Bidding and Administrative Contracts nº 14.133/21. In this regard, the article nº 151 of the aforementioned legal framework is the first provision to expressly introduce the DBs to the administrative contracts of the Union, relying on the increasing advancement of this mechanism in the field of public law. Given this legislative novelty (which is not so new, as will be explained in due course), this Final Paper aims to investigate the suitability of Dispute Boards to the principles that rule the Public Administration and, consequently, administrative contracts. To achieve this, firstly, it is presented the alternative means of dispute resolution established in the new Law on Bidding and Administrative Contracts and the differences they show in relation to DBs. Subsequently, the different types of Dispute Boards will be analyzed, as well as a brief historical overview of their development. After the explanation of what they are and how they work, using a deductive method through bibliographic research, the compatibility and controversies of these methods will be analyzed in relation to the principles that govern the Public Administration.
