A atual política de doação anônima de gametas dá origem a uma potencial colisão de direitos da personalidade: de um lado, o direito do indivíduo concebido através de técnica de reprodução humana assistida ao conhecimento de sua origem genética; de outro, o direito à privacidade do doador anônimo de gametas. O presente trabalho tem por objetivo analisar como a mencionada colisão pode ser resolvida de forma racional. Para tanto, através da revisão bibliográfica e da análise de decisões estrangeiras, busca-se destacar os elementos que fornecerão ao aplicador do Direito as condições de solucionar o problema concreto, satisfazendo a uma pretensão de correção. Adotando-se uma teoria externa das restrições aos direitos fundamentais, o direito ao conhecimento da ascendência biológica é analisado primeiramente como “direito em si”, não restringido, perquirindo-se sobre sua classificação, estrutura e fundamentação. A partir do estudo de casos, o direito ao conhecimento da origem genética passa a ser analisado como “direito restringido”, diante da necessidade de sua compatibilização com direitos individuais de terceiros e bens coletivos. Partindo de uma concepção discursiva do Direito, não se admite a existência de direitos absolutos, de modo que a colisão entre direitos subjetivos é resolvida através da ponderação, orientada pelo princípio da proporcionalidade. Demonstra-se de que forma o Código Civil, por meio de suas cláusulas gerais, fornece ao intérprete do direito a abertura discursiva necessária para a solução da colisão, permitindo uma proteção aos direitos da personalidade que dispensa uma fundamentação constitucional indireta. The current policy of anonymous donation of gametes gives rise to a potential collision of personality rights: on the one hand, the right of the individual conceived through human reproduction technique assisted to the knowledge of his genetic origin, on the other, the right to privacy of the anonymous gamete donor. The present work aims to analyze how the mentioned collision can be resolved in a rational way. To this end, through bibliographic review and analysis of foreign decisions, it is sought to highlight the elements that will provide the Law enforcer with the conditions to solve the concrete problem, satisfying a claim for correction. Adopting an external theory of restrictions on constitutional rights, the right to knowledge of biological ancestry is analyzed first as a “right in itself”, not restricted, investigating its classification, structure and reasoning. From the case study, the right to knowledge of the genetic origin is now analyzed as a “restricted right”, given the need to make it compatible with the individual rights of third parties and collective goods. Starting from a discursive conception of Law, the existence of absolute rights is not allowed, so that the collision between subjective rights is resolved through weighting, guided by the principle of proportionality. It demonstrates how the Civil Code, by means of its general clauses, provides the interpreter of the right with the necessary discursive opening for the solution of the collision, allowing a protection to the rights of the personality that dispenses with an indirect constitutional reasoning. Finally, the policy of anonymity is discussed and the need to take into account, in the legislative discussion about the discipline of assisted human reproduction techniques, also the interests of the individual to be conceived, as potential affected by the norm. ...
