Este trabalho se debruça sobre a questão da justificação das decisões judiciais por parte dos magistrados, em especial no que tange à ocorrência de petição de princípio. A pesquisa busca responder quais são os parâmetros exigidos pelo ordenamento jurídico brasileiro em relação à necessidade de fundamentação dos atos decisórios dos magistrados. Em um segundo momento, a partir da estrutura argumentativa sustentada por Stephen E. Toulmin e as explicações conceituais de Aristóteles, bem como Lucie Olbrechts-Tyteca e Chaim Perelman a respeito da petição de princípio observa-se especialmente possibilidades de incidência da falácia de petição de princípio bem como possíveis consequências ao sistema jurídico como um todo. Conclui-se que a permissividade do ordenamento jurídico em relação à justificação do julgado é prejudicial ao próprio sistema legal bem como aos indivíduos que ele se propõe a tutelar, e que se faz necessária a ampliação dos estudos a respeito da petição de princípio em sede de decisões judiciais bem como o desenvolvimento de um método para sua identificação que seja adequado à complexidade dos argumentos jurídicos e os elementos que os circundam. ...

This paper addresses the question of the justification of judicial decisions by magistrates, in particular as regards the occurrence of begging the question. The research seeks to answer what are the parameters required by the Brazilian legal system in relation to the need of reasoning the decision-making acts of the judges. This paper addresses the question of the justification of judicial decisions by magistrates, in particular as regards the occurrence of begging the question. The research seeks to answer what are the parameters required by the Brazilian legal system in relation to the need of reasoning the decision-making acts of the judges. Secondly, from the argumentative structure supported by Stephen E. Toulmin and the conceptual explanations of Aristotle, as well as Lucie Olbrechts-Tyteca and Chaim Perelman about begging the question, it is possible to observe in particular the possibilities of the fallacy of the begging the question, as also possible consequences for the legal system as a whole. It is concluded that the permissiveness of the legal system in relation to the justification of the trial can be harmful to the legal system itself, as well as to the individuals that aims to protect. In addition, it is concluded that is necessary to expand the studies on begging the question in court decisions and to develop a method for its identification that is appropriate to the complexity of the legal arguments and the elements surrounding them. ...
