Esta monografia procura estabelecer os limites da intervenção estatal nas liberdades individuais e coletivas garantidas aos cidadãos em um estado democrático de direito no caso do consumo da ayahuasca, considerada a ponderação entre as liberdades e os direitos que eventualmente seriam violados, ora pela liberação do uso da substância ora pela sua proibição. Para tanto, em um primeiro momento, é feita uma breve reconstituição histórica dos usos da ayahuasca e a regulamentação desta no Brasil. Após, são analisadas, através da revisão bibliográfica sobre os temas, bem como análise de jurisprudência, a liberdade religiosa, a autonomia e a soberania pessoal, o dano de autolesão e a sua repercussão na proteção à saúde pública. O objetivo é identificar se a proibição da bebida se trata de um mero ato de paternalismo legal e se ela se justifica em um estado minimamente liberal. Perpassando pela compreensão do valor e do significado das liberdades que estão em pauta quando da verficiação da legitimidade da proibição da conduta de consuma da ayahuasca, conclui-se que não há, no contexto brasileiro (e dos países ocidentais em geral) razões plausíveis para a sua proibição. É que, de fato, se trata de um ato paternalista do Estado, pois (I) a conduta, se eventualmente causar lesão, será apenas para o indivíduo que livremente optou por tomá-la, e seus atos estão protegidos pela sua autonomia, e (II) existe o direito à liberdade religiosa, e principalmente a pluralidade relgiosa, cujo respeito que tem valor significativo nas democracias. ...

This paper aims to establish the limits of state intervention in the individual and collective freedoms guaranteed to the citizens of a democratic rule-of-law state concerning the consumption of ayahuasca. It considers the deliberation between the freedoms and rights that would eventually be violated, either for the liberation of the use of the substance or its prohibition. To do so, a brief historical reconstitution of the uses of ayahuasca and its regulation in Brazil is made. Afterwards, through bibliographic review of the topics, in addition to analysis of judicial decisions, the religious freedom, the autonomy and personal sovereignty is analyzed, as well as the damage of self-harm and its repercussion in the protection of public health. Thus, it is sought to identify whether the prohibition of ayahuasca is only an act of legal paternalism and if it is justified in a minimally liberal state. Through the understanding of the value and meaning of the freedoms that are under consideration when verifying the legitimacy of the prohibition of ayahuasca consumation, it is concluded that there are no plausible reasons in the Brazilian context (and the Western countries in general) for its prohibition. It is, in fact, a paternalistic act of the State, because (I) the conduct, if eventually causes injury, will be only for the individual who freely chose to take it, and his acts are protected by his autonomy, and (II) there is the right to religious freedom, and especially the peoples religious plurality whose respect has significant value in democracies. ...
