Práticas contratuais e redes de interação : estudo de caso sobre o BRDE – Banco Regional de Desenvolvimento do Extremo Sul

Abstract

O Banco Regional de Desenvolvimento do Extremo Sul (BRDE) iniciou, em 2016, tratativas com a Agência Francesa de Desenvolvimento (AFD) para financiar o desenvolvimento sustentável, culminando em contratos de cooperação técnica. A construção dessas relações não é trivial, envolvendo intercâmbios de conhecimentos nas organizações, a negociação de princípios de justiça e a afirmação de escalas de valores. Os contratos expressam as normas que regulam a complexidade dessas trocas econômicas. O problema desta pesquisa tem como foco responder à pergunta: quais são as práticas contratuais com mutuários desenvolvidas pela parceria do BRDE com a AFD? Para tanto, realizou-se uma análise documental com acesso a informações provenientes da base de dados do BRDE, considerando as operações contratadas com a AFD e com outras instituições parceiras do BRDE. Além disso, foram enviados questionários via e-mail aos gestores que estiveram envolvidos diretamente na negociação da cooperação AFD-BRDE. Os resultados obtidos apontam que a interação entre BRDE e AFD tende a alterar as práticas contratuais com os clientes-mutuários do BRDE, gerando convenções entre os agentes que acabam se institucionalizando em contratos sociais. Introduziram-se, por exemplo, novas práticas para a análise de projetos, novas cláusulas nos contratos firmados com mutuários beneficiados com os recursos oriundos da linha AFD e, por fim, informações substanciais quanto à quantidade de energia gerada por fonte renovável, emissões de gases de efeito estufa evitadas e mitigação das emissões de gases. Conclui-se que as redes de interação entre AFD-BRDE impactaram as práticas contratuais que o BRDE estabelece com seus mutuários clientes, especialmente pela implantação da mensuração do risco socioambiental.

In 2016, the Regional Development Bank of the Far South (BRDE) began negotiations with the French Development Agency (AFD) to finance sustainable development, culminating in technical cooperation contracts. The construction of these relationships is not trivial, involving exchanges of knowledge in organizations, the negotiation of principles of justice and the affirmation of scales of values. Contracts express the rules that regulate the complexity of these economic exchanges. The problem of this research is focused on answering the question: what are the contractual practices with borrowers developed by the partnership between BRDE and AFD? For that, a documental analysis was carried out with access to information from the BRDE database, considering the operations contracted with the AFD and with other partner institutions of the BRDE. In addition, questionnaires were sent via e-mail to managers who were directly involved in the negotiation of AFD-BRDE cooperation. The results obtained show that the interaction between BRDE and AFD tends to change contractual practices with BRDE's borrower-clients, generating conventions between agents that end up institutionalizing themselves in social contracts. For example, new practices were introduced for project analysis, new clauses in contracts signed with borrowers benefiting from the resources from the AFD line and, finally, substantial information on the amount of energy generated by a renewable source, gas emissions greenhouse effect emissions and mitigation of gas emissions. It is concluded that the interaction networks between AFD-BRDE impacted the contractual practices that BRDE establishes with its client borrowers, especially by implementing the measurement of socio-environmental risk.
