Reforma Trabalhista (Lei nº 14.367/2017) : medida de contratendência à queda da taxa de lucro

Abstract

O presente trabalho visa estudar a origem e apontar as consequências da Reforma Trabalhista de 2017, no que diz respeito as relações de trabalho no Brasil. Partindo da hipótese de que as alterações promovidas pela Lei 14.367/2017 atendem, principalmente, os interesses da classe empresarial, e, com o objetivo de compreender a sua origem, é realizado uma retrospectiva das modificações nas relações trabalhistas desde a década de 1990 no Brasil, momento em que a flexibilização do trabalho e o neoliberalismo ganham força no país. Através de uma revisão da literatura que versa sobre o tema, é explorado às raízes do neoliberalismo e da acumulação flexível, bem como a conjuntura mundial em que estes dois fenômenos ganharam espaço. Conclui-se que a contrarreforma de 2017 está inserida em uma tendência histórica de retirada de direitos trabalhistas, de flexibilização do trabalho que, na prática, representa uma precarização do trabalho, com intuito de elevar os lucros dos empregadores em detrimento da diminuição da remuneração e dos direitos que garantem maior estabilidade e segurança para os trabalhadores.

The present work aim to study the origin and show the consequences of the Labor Reform of 2017 to the working relations in Brazil. Beginning with hyphotesis that the changes made by the Law 14.367/2017 advocates the interests of the enterpreuneur classe and, with the intend to compreend it’s origin, it’is analysed the modifications in the working relationships since the 1990’s decade in Brazil, because it’s the moment that neoliberalism and productive restructuring gain strenght in the country. Through a literature review about the theme, it’s explored, previously, the roots of neoliberalism and the flexible accumulation, as well as the world economic’s conjuncture when both become relevant. In this way, we conclude that counter-reform of 2017 it’is inserted in a history trend marked by the loss of labour rights and the flexibilization of the work, wich representes the precarization of the working class exploration in order to elevate the profit of the employers at the expense of lower salaries and the worse of the rights of the working class.
