dc.description.abstractO presente estudo trata da definição do critério espacial de incidência do ISSQN segundo os princípios constitucionais da autonomia municipal, do federalismo e da territorialidade tributária. Considerando que a distribuição de competências tributárias é formulada de forma rígida pela Constituição Federal, abordaremos a possibilidade de a Lei Complementar nº 116/03, a pretexto de fixar normas gerais e dirimir conflitos de competência em matéria tributária, tenha a possibilidade de alterar a regra definida segundo o princípio da territorialidade tributária, que determina a competência dos municípios dentro de sua área geográfica. Para o desenvolvimento do estudo, abordaremos os critérios integrantes da regra-matriz de incidência do Imposto, segundo o princípio da territorialidade e as possibilidades de relativização deste princípio nas situações que envolvam os chamados serviços multilocais ou fracionados e as importações de serviços. A dissertação tem como tema central a discussão acerca da possibilidade de cobrança do ISSQN – Imposto sobre Serviços de Qualquer Natureza –, de acordo com a regra estabelecida na legislação complementar, que prevê a incidência do imposto no local onde situado o estabelecimento prestador ou no domicílio do prestador. Nosso objetivo é provar que esta regra não está de acordo com a Constituição Federal e que a correta definição da competência para a cobrança do ISSQN é estipulada segundo o local onde efetivamente prestados os serviços, entendimento este que encontra respaldo nas decisões atualmente proferidas pelo Superior Tribunal de Justiça.pt_BR
dc.description.abstractThe present study is about the definition of space criteria of incidence of the ISSQN according to the constitutional principles of municipal autonomy, federal principle and territoriality taxation. Considering that the distribution of tributary competences is formulated in a rigid way by the Federal Constitution, this study will approach the possibility of the Declaratory Statute nº 116/03, whit the pretext of assigning general norms and resolve competence conflict off tributary laws, given the possibility off changing the rule defined according to the territorial taxation principle, that determines the competence of the municipalities within their geographic area. For the development of the study, the criteria integrating the rule array of the tax incidence will be approached, according to the principle of territoriality and the possibilities of relativization of this principle in the situations involving so-called multi-site and fractional services and the importations of service. The dissertation has as central subject the discussion about the possibility of collection of ISSQN (Acronym for Tax on Services of Any Nature), according the rule established on the declaratory legislation, which predicts the incidence of tax in the site where either the business or the domicile of the service provider are located. The goal in this study is to prove that this rule is not in accordance with the Federal Constitution and that the accurate definition of the competence to collection of ISSQN is determined according to the site where the services were effectively rendered, such understanding that is supported by the recent decisions of the STJ court (Superior Court of Justice).en
