Os possíveis reflexos da redução da maioridade penal nos índices de violência

Abstract

O presente trabalho analisa em que medida a aprovação de alguma das Propostas de Emenda à Constituição que tramitam no Congresso Nacional é capaz de efetivamente incidir nos índices de violência em que jovens são autores. Verifica-se que o argumento central das propostas e discursos dos parlamentares favoráveis à redução da maioridade penal é no sentido de que a redução será propulsora da diminuição dos índices de violência. Assim, a problemática foi desenvolvida em razão da hipótese de que a mera redução da idade de imputabilidade penal não tem capacidade de desencadear a diminuição dos índices de violência. O ponto de partida do presente trabalho é a análise do tratamento e da responsabilização das crianças e dos adolescentes ao longo da história no Brasil e na América Latina. Na sequência, é exposto como ocorre o tratamento e a responsabilização no Brasil atualmente. Em um segundo momento, são analisadas as Propostas de Emenda à Constituição visando à redução da maioridade penal que tramitam ou tramitaram no Congresso Nacional, bem como os argumentos favoráveis e contrários à redução. Por fim, é feita uma análise dos elementos atinentes à manifestação do fenômeno da violência nas esferas que, de alguma forma, incidam sobre crianças e adolescentes que figuram como autores em episódios violentos. Assim, constata-se que a redução da maioridade penal não tem potencial para diminuir os índices de violência em que jovens são autores e, ainda, que a redução poderá apresentar efeito inverso ao imaginado e desejado, aumentando ainda mais os índices de violência da sociedade brasileira.

The current paper analyzes to what extent the approval of one of the Proposed Amendments to the Brazilian Constitution, that process through the National Congress, is capable of effectively impact in the violence index that young are involved. The main argument of the proposals and also of the parliamentarians speeches in favor to the reduction of the age for criminal responsibility is that the reduction will be the engine of the violence's index reduction. Therefore, the problem was developed around the hypothesis that the reduction of the age for criminal responsibility itself isn't capable of triggering the reduction of the violence index. The starting point of the present work is the analysis of the treatment and the accountability of children and teenagers along the history of Latin America and Brazil. In the following, the paper shows how is the treatment and the accountability in Brazil nowadays. Later on, the Proposed Amendments to the Constitution are analyzed seeking the reduction of criminal’s responsibility age that process or have been processed in the National Congress, as well as the favorable and counter arguments to the reduction. Lastly, there is an analysis of the elements regarding the manifestation of the violence's phenomenon which impact over children and teenagers responsible for violent acts. Thereby, it is noted that the reduction of the age for criminal responsibility doesn't have the power to lower the violence index in which young are responsible and, furthermore, that the reduction may show the opposite effect to what was expected, increasing, even more, the violence index of the Brazilian society.
