dc.description.abstractO tema do presente trabalho de conclusão é o instituto da estabilização da tutela, previsto no art. 304 do código de processo civil, e possui o objetivo de analisar, de modo crítico, a previsão legal e a sua aplicação conforme os princípios e normas constitucionais. De acordo com o código, ocorrida a estabilização, a tutela antecipada torna-se estável e o processo em que fora concedido extingue-se. A partir desse momento, a tutela estabilizada somente poderá ser alterada ou revogada por ação própria, cujo prazo decadencial para ajuizamento é de dois anos. A previsão legal do instituto gerou volumoso debate doutrinário e em especial no que se refere à sua eficácia após o decurso do prazo referido. Neste ponto, divide-se a doutrina quanto à questão acerca do que se forma nesse momento: parte dela entende se configurar coisa julgada material, enquanto outros doutrinadores apontam a uma outra forma de estabilidade, que não se confunde com aquela. Ainda, há quem aponte, inclusive, a inconstitucionalidade do instituto por se pretender coisa julgada, o que não é possível. Ocorre que, de fato, o fenômeno da estabilização acaba por produzir uma nova espécie de estabilidade processual, capaz de gerar a indiscutibilidade acerca da tutela antecipada estabilizada, independente da coisa julgada material. Afasta a possibilidade de rediscussão judicial do objeto da referida tutela com o intuito de alterar os efeitos práticos decorrente da estabilização.pt_BR
dc.description.abstractThe subject matter of this term paper is the institute of stabilization of the decisions taken in anticipation of tutelage foreseen in the article 304 of the Code of Civil Procedure and has the intent of critically analyzing the legal forecast and its application according constitutional principles and norms. Acordding to the Code once stabilization has taken place the antecipation of tutelage becomes stable and the procedure in which it was granted is extinguished. From this moment the stabilized tutelage only can be altered or revoked by lawsuit whose decadential term is two years. The legal forecast of this institute generated a large doctrinal debate and in particular in the regard to its effectiveness after the said decadential term. In this matter the doctrine is divided on the issue about what is formed in this moment as part of it understands that is set up material res judicata while others indoctrinators point to another form of stability that is not confused with the res judicata. There are still those who point to the unconstitutionality of the institute for wanting to establish res judicata, what is not possible. It occurs that in fact the stabilizing phenomenon ends up producing a new kind of procedure stability able to generate the indisputability about the stabilized antecipaded tutelage independently of the material res judicata. It removes the possibility of judicial rediscussion about the object of the stabilized tutelage in order to change the practical effects due to the stabilization.en
