Os efeitos da recuperação judicial nas empresas de infraestrutura

Abstract

O presente trabalho visa analisar os efeitos da recuperação judicial nas empresas de infraestru-tura, verificando o que as leva à situação de crise e quais meios utilizam para resolver os pro-blemas financeiros, manter as operações e realizar o pagamento aos credores. Esse tema se mostra relevante tendo em vista a importância do ramo empresarial da infraestrutura para o país, e pelo fato de esse setor atravessar por uma crise sistêmica, em que há escassez de crédi-to e faltam opções de mercado para superar as dificuldades financeiras. O contexto histórico do Brasil, a partir do ano de 2014, teve como resultado um número expressivo de empresas de infraestrutura necessitando da recuperação judicial para sanar os problemas financeiros, pois além da falta de investimentos de capital privado, o principal cliente dessas empresas, a admi-nistração pública, também entrou em contenção de gastos, agravando ainda mais a crise no setor. Na recuperação judicial as empresas encontram ferramentas para manter as atividades, realizar o pagamento devido aos credores e reestruturar a empresa financeira, societária e ad-ministrativamente. A metodologia utilizada nesta pesquisa consiste na análise de processos de empresas em recuperação judicial da área da infraestrutura, estudo de notícias de diversos veículos de comunicação quanto ao assunto, coleta de dados estatísticos e pesquisa doutriná-ria. É possível verificar que apesar da crise geral do setor, o instituto da recuperação judicial contempla diversas ferramentas para contornar os problemas das empresas, com soluções es-pecíficas para o campo da infraestrutura.

This research aims to study the effects of the judicial recovery of infrastructure companies analyzing the factors which take an enterprise to the crisis point and all the forms used to solve their financial problems, keep them operative and pay their creditors. This theme is a relevant one when the important sector of infrastructure of the country is at stake, also consid-ering that this area is going through a systemic crisis due to the lack of credit and the lack of options to solve the crisis in the financial market. The historical context in the country from 2014 on resulted in a large number of infrastructure enterprises turning to the judicial recov-ery process to solve their financial problems, for, not only there was a lack of private capital investments (their main clients), but also the Government spent less, getting the crisis worse in the sector. The judicial recovery process allows these companies to keep themselves opera-tive, pay their creditors, and financially, corporate and administratively reorganize them-selves. The methodology employed in the present research will cover the analysis of some judicial recovery process of companies of infrastructure, the studying of varied media re-sources on the subject, the gathering of statistics data and doctrinal research. It is possible to notice that despite the general crisis of the sector, the judicial recovery process covers varied tools the aid these companies to solve their financial issues, counting on specific solutions for the infrastructure area.
