A construção da divergência : art. 942 do CPC/2015

Abstract

O presente estudo examina a técnica de ampliação de julgamento prevista no art. 942 do novo Código de Processo Civil. A técnica foi inserida no texto legal em substituição aos embargos infringentes, os quais suscitavam polêmicas há muito tempo, tanto na doutrina como na jurisprudência. A fim de melhor compreender o instituto criado, em um primeiro momento, será analisada como era a vigência dos embargos infringentes no Código de Processo Civil de 1973 e as controvérsias que existiam. Após, será analisada a tramitação do novo Código no Congresso Nacional, com foco no tema aqui proposto. Assim será possível analisar com precisão o art. 942 e as polêmicas que dele resultam, as antigas (já existentes quanto aos embargos infringentes) e as novas, demonstrando que a técnica mantém vivas as divergências anteriores e cria outras, não sendo um instituto simples. Ademais, também não deve ser lida de forma isolada, tanto em relação ao seu passado como ao contexto do novo Código em que se insere.

This study examine the technic of judgement's expansion expected in article 942 of the new Code of Civil Procedure. The technic was introduced in the Code in replacement of the “embargos infringentes”, that give rise to polemics since a long time, both in doctrine and in jurisprudence. To understand better the institute created, in a first moment, will be analysed how was the effectiveness of “embargos infringentes” in the Code of Civil Procedure of 1973 and the controversies existents. After, will be analysed the procesing of the new Code in Congress, with focus on the theme here proposed. Then will be possible to analyse with precision the article 942 and the polemics resulting from him, the old ones (already existents for the “embargos infringentes”) and the new ones, demostrating that the technic keep the old divergences alive and create others, not being a simple institute. Moreover, should not be read individually, neither in relation of her past nor the context of the new Code which is inserted.
