dc.description.abstractOs direitos humanos ocupam lugar de destaque na atualidade, em torno dos quais giram as mais diversas discussões. Os maiores qustionamentos decorrem dos impasses encontrados entre a universalidade dos direitos e os aspectos multiculturais, bem como acerca de sua efetividade. A partir da consolidação dos direitos humanos como caráter universal, surgiram muitas indagações no contexto internacional, e considerando que a família foi um dos institutos em que se manifestam com maior intensidade as transformações científicas, tecnológicas e morais, as maiores dúvidas surgem no âmbito do direito internacional de família, entre as quais, aquelas decorrentes da medicina reprodutiva, em que a busca por opções de tratamento de países estrangeiros desenvolveu o chamado "turismo reprodutivo". Considerando o pluralismo pós-moderno, não há uma metodologia particular para solucionar os problemas, as respostas podem ser encontradas no conjunto de fontes, quais sejam; o ordenamento jurídico interno e internacional, o conjunto de normas e princípios de direitos humanos de caráter universal, os aspectos multiculturais e os processos de integração supranacional.pt_BR
dc.description.abstractHuman rights, about which many discussions are held, have currently a prominent place. The major questions arise from deadlocks found between the universality of rights and the multicultural aspects, as well as about their effectiveness. Since the consolidation of human rights as universal, there have been many questions in the international context, and considering that the family was one of the institutions in which the scientic, technological and moral transformations have manifested with greater intensity, the major questionsarise under the scope of international family law, incluiding those from reproductive medicine, in which teh search for treatment options in foreign countries developed the so-called "reproductive tourism". Considering postmodern pluralism, there is not a particular methodology to solve problems, the answers can be found in the set of sources, namely; the internal and international legal order, the set of universal norms and principles of human tights, the multicultural aspects and the processes of supranational integration.en
