dc.description.abstractA presente monografia objetiva examinar a validade da forma de pactuação dentro dos contratos de trabalho geralmente conhecida como cláusula de permanência, pela qual é acordado que o empregado não denunciará seu contrato durante determinado lapso temporal, permanecendo a serviço de seu empregador como forma de contraprestação por investimentos financeiros que este tenha realizado na especialização ou formação profissional daquele, sob pena de, com seu descumprimento, o obreiro ter de pagar indenização ao seu ex-empregador. Esta análise pretende abordar o assunto sob a ótica da (in)compatibilidade das cláusulas desta natureza dentro do atual ordenamento jurídico, no qual prevalece a proteção ao trabalhador, visto que impõe obrigação que, aparentemente, acarreta em restrição à sua liberdade de trabalho. Inicialmente, será analisada a presença do fator trabalho dentro dos principais sistemas econômicos existentes na história, com enfoque no tema da liberdade do obreiro na prestação dos serviços Em seguida, analisar-se-á o direito fundamental à liberdade de exercício de profissão, com garantia expressa na Constituição Federal vigente, abordando a interpretação atribuída a tal direito pelo Supremo Tribunal Federal em casos paradigmas. Será feita, ainda, breve explanação a respeito da introdução de novas tecnologias nos locais de trabalho e seus efeitos no direito ao trabalho, principalmente em perspectiva de sua influência como fator de desemprego e subemprego, contexto no qual o estímulo à qualificação profissional dos empregados apresenta grande relevância, sendo objeto de interesse tanto de funcionários quanto de empresas. Após estas considerações, será exposto o tratamento legislativo que a doutrina entende aplicável à espécie, destacando-se a inexistência de regulação específica no ordenamento jurídico atual e a necessidade de utilização de normas subsidiárias dos contratos em geral. Por fim, será abordado o atual posicionamento da jurisprudência sobre o tema, a qual vem se firmando, ainda que não de maneira absoluta, no sentido de reconhecer a validade da cláusula, salvo nos casos em que os termos ajustados, no caso concreto, demonstrarem a sua abusividade.pt_BR
dc.description.abstractThe present monograph aims to examine the validity of the form of pact within the employment contracts commonly known as permanence clauses, whereby it is agreed that the employee will not terminate his contract during a certain time span, staying at his employer service as a way of payment for financial investments that the second has made in the specialization or training of the first, otherwise, in non-compliance, the worker has to pay compensation to his former employer. This analysis aims to address the issue from the perspective of the (in)compatibility of clauses of this nature within the current legal framework, in which prevails the protection to workers, since it imposes obligations which, apparently, lead to the restriction on their freedom to work. Initially, it analyses the presence of labor within the main economic systems in history, focusing on the theme of workers' liberty of work Then it discusses the fundamental right to freedom of profession, which is expressly guaranteed in the current Constitution, covering the interpretation given to this right by the Supreme Court in leading cases. It also briefly exposes an explanation regarding the introduction of new technologies in the workplace and its effects on the right to work, particularly in view of its influence as an unemployment and underemployment factor, context in which the stimulus of professional qualification of employees shows great relevance, being a subject of interest for both employees and companies. After these considerations, it exposes the legislative treatment that the doctrine understands applicable to the matter, highlighting the lack of specific regulation in the current legal framework and the need to use the subsidiary law applied to contracts in general. Finally, it addresses the current positioning of jurisprudence on the subject, which has established itself, although not absolutely, to recognize the validity of the clause, except in cases where the set terms demonstrate their abuse.en
