O processo de implementação da Lei nº 11.769/2008 : o caso da microrregião de Guanambi/BA

Abstract

O objetivo geral deste trabalho foi analisar o processo de implementação da Lei nº 11.769/08 nas secretarias municipais de educação da microrregião de Guanambi/BA. Os objetivos específicos buscaram examinar os sentidos atribuídos pelas secretarias à Lei nº 11.769/08; analisar políticas, programas, projetos ou ações elaborados em direção à implementação e à avaliação de seus impactos e, por fim, identificar os sujeitos envolvidos nesse processo. O referencial teórico foi construído de modo a abarcar a trajetória de políticas educacionais e elementos para a análise de processos de implementação, tendo sido utilizadas proposições da Abordagem do Ciclo de Políticas e de Luciana Lima e Luciano D’Ascenzi. O método escolhido foi o estudo de caso incorporado, sendo que as subunidades de análise foram as secretarias municipais de educação da microrregião de Guanambi/BA. Participaram da pesquisa 19 representantes de 15 secretarias municipais de educação do total de 18 municípios da microrregião. Como técnicas de coleta de dados foram utilizadas entrevistas semiestruturadas e pesquisa documental. Os resultados indicam que a Lei foi bem recebida nos municípios pela importância atribuída à música nos contextos escolares. O conhecimento da Lei, entretanto, ainda é pouco aprofundado. A interpretação do texto legal, em direção à sua implementação, está associada às possibilidades de que os municípios dispõem para traduzi-lo no contexto da prática. O planejamento da implementação encontra-se em diferentes fases nos municípios e não apresenta uma sistematização no que se refere ao seu registro, tendo sido construído principalmente por meio de discussões entre diferentes sujeitos envolvidos com as escolas. As experimentações de implementação ocorreram em poucos municípios, no entanto, a música estava presente em diferentes tempos e espaços nas escolas municipais. A principal dificuldade para a implementação efetiva da Lei consiste na escassez de profissionais que possam atuar com o ensino de música nas escolas. As representantes dos municípios apontaram perspectivas futuras de implementação e proposições para otimizar o processo, o que evidenciou que, apesar de ressaltarem a necessidade de direcionamentos acerca da implementação da Lei, indicam caminhos possíveis para sua implementação. Os resultados deste trabalho poderão subsidiar ou fomentar ações futuras para a concretização do ensino de música na microrregião de Guanambi/BA, bem como apoiar a reflexão e a definição de estratégias e procedimentos de implementação da Lei em outros contextos educacionais no país, contribuindo, assim, para o fortalecimento do ensino de música nas escolas de educação básica.

The aim of this study was to analyze the process of implementation of the Law N. 11.769/08 in the municipal education secretariats of the micro region of Guanambi/BA, Brazil. The specific objectives sought to examine the meanings attributed by the secretariats to the Law N. 11.769/08; to analyze policies, programs, projects or actions designed towards the implementation and evaluation of their impacts and, finally, to identify the subjects involved in this process. The theoretical framework was constituted by propositions from the Policies Cycle Approach and the elements for the analysis of processes of implementation presented by Luciana Lima and Luciano D'Ascenzi. The method chosen to carry out this research was the embedded case study, taking as its subunits the municipal education secretariats of the micro region of Guanambi/BA. The participants were 19 representatives from 15 secretariats of education of the micro region. Data were collected through semi-structured interviews and analysis of documents. The results indicate that the law was well received in the municipalities because of the importance given to music in schools. Knowledge of the Law, however, is still little depth. The interpretation of the legal text, towards its implementation, is associated with the possibilities the municipalities have to translate it in the context of practice. The planning of the implementation is at different stages in the municipalities and is not systematically registered. It was elaborated mainly through discussions among the different subjects involved with the schools. Some trials occurred in a few municipalities; however, music was present in different times and spaces in the municipal schools. The main difficulty for the effective implementation of the Law is the shortage of professionals who can work with music education in schools. The representatives of the municipalities indicated future prospects of implementation and proposals to optimize the process, which showed that while they bounce the need to directions on the implementation of the Law, they indicate possible ways to implement it. These results may support or encourage future actions for the implementation of music education in the micro region of Guanambi/BA. They can also support reflection and the definition of strategies and procedures to implement the Law in other educational contexts in Brazil, contributing to strengthen practices of school music education.
