Poder normativo da Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP)

Abstract

Este trabalho tem o objetivo central de analisar o alcance do poder normativo da Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP), verificando a legalidade do desempenho desta função. Além disso, foram pesquisados os conseqüentes objetivos específicos: histórico da reforma administrativa da década de 1990 e da criação das agências reguladoras; grau de autonomia das agências reguladoras; relação de vinculação/subordinação entre as agências reguladoras e os Poderes Legislativo, Executivo e Judiciário; e a atuação prática da ANP com relação ao seu poder normativo. Relativamente à estrutura, este texto está dividido em quatro capítulos. O primeiro capítulo versa sobre o modelo gerencial e a reforma do aparelho do Estado brasileiro na década de 1990, relatando o ambiente e também o processo de criação das agências reguladoras por parte do Ministério da Administração Federal e Reforma do Estado, com uma breve crítica aos resultados obtidos. O segundo capítulo expõe o estudo das agências reguladoras em relação às suas autonomias administrativa, financeira e normativa, além de avaliar as influências dos Poderes Legislativo, Executivo e Judiciário sobre a atuação e funcionamento dos entes reguladores, principalmente em relação aos seus poderes regulamentares. O terceiro capítulo efetua uma contextualização histórica e operacional da Agência Nacional do Petróleo, Gás Natural e Biocombustíveis a fim de caracterizar o ente administrativo para melhor compreender sua situação atual. O capítulo final realiza exame crítico da função normativa exercida pela ANP no setor brasileiro de petróleo, gás natural e biocombustíveis através da análise de diversos aspectos de sua atuação no seu domínio regulado. Em conclusão, o estudo apresenta que a tão proclamada autonomia das agências reguladoras na prática é um mito devido às influências externas (mercado) e internas (governo), sendo que o poder normativo das agências reguladoras é extremamente limitado pelos princípios da legalidade e pela subordinação às políticas públicas definidas pelo governo.

This work has the main objective to analyze the scope of the legislative power of the National Agency of Petroleum, Natural Gas and Biofuels (ANP), verifying the legitimacy of the execution of this function. Furthermore, the consequential specific objectives were investigated: history of the Brazilian administrative reform of the 1990s and the creation of regulatory agencies; the degree of autonomy of the regulatory agencies; binding/subordination relationship between regulatory agencies and the Legislative, Executive and Judicial powers; and practical application of the ANP in relation to its normative power. Regarding the structure, this text is divided into four chapters. The first chapter deals with the management model and the reform of the Brazilian state apparatus in the 1990s, describing the environment and also the process of creation of regulatory agencies by the Ministry of Federal Administration and State Reform, with a brief review of the results obtained. The second chapter presents the study of regulatory agencies regarding their administrative, financial, and normative autonomy, in addition to evaluate the influences of the Legislative, Executive and Judicial powers on the role and operation of regulatory organizations, mainly in relation to its regulatory powers. The third chapter makes a historical and operational context of the National Agency of Petroleum, Natural Gas and Biofuels in order to characterize the administrative organization to better understand its current situation. The final chapter performs critical examination of the regulatory function exercised by ANP in Brazilian petroleum, natural gas and biofuels sectors through the analysis of various aspects of its operations at its regulated area. In conclusion, the study shows that the muchvaunted autonomy of the regulatory agencies in practice is a myth due to external (market) and internal (government) influences, while the normative power of regulatory agencies is extremely limited by the principles of legality and subordination to the public policies set by the government.
