Os efeitos da política criminal de drogas sobre o perfil da mulher selecionada pelo direito penal

Abstract

A criminalidade das mulheres restou por muitas décadas encoberta por um esforço científico dedicado a fornecer explicações sobre a criminalidade geral, sem o necessário recorte de gênero. Quando muito, o fenômeno era restrito a notas de rodapé em obras construídas por homens e sobre os homens em conflito com o direito penal, ou, ainda, era objeto de teses biologicistas, que propunham diferenciar a criminalidade feminina a partir de dados anatômicos e biológicos que diferenciariam mulheres e homens. Com o desenvolvimento e o influxo do paradigma de gênero no âmbito da ciência, passou-se à compreensão de que o gênero, o ser mulher, é resultado de uma construção social, desvinculado do sexo como dado biológico. Na esfera da criminologia crítica, o aporte dessa construção das pensadoras feministas da década de setenta permitiu se estudasse a criminalização das mulheres por uma ótica distinta, levando em consideração, sobretudo, os diferentes processos de socialização a que sujeitos homens e mulheres e a atuação de instâncias informais de controle social voltado primordialmente às mulheres. À luz dessas novas formulações, inseridas no âmbito das criminologias feministas, foi possível investigar a criminalização das mulheres e o perfil sócio-jurídico da mulher encarcerada em Porto Alegre, a partir de dados disponibilizados por órgãos públicos do setor. Os resultados, associados ao estudo teórico inicialmente apresentado, permitiram ampliar a compreensão da inserção das mulheres nas estruturas do tráfico de drogas e visualizar como a seleção dessas mulheres pelo sistema penal alterou outras características da população carcerária feminina.

Women’s criminality has remained for many decades concealed under a scientific effort dedicated to providing explanations about general criminality, without the necessary gender perception. If any, the phenomenon was restricted to footnotes in works made by men and about men in conflict with criminal law, or yet, it was the aim of biologicist theses which proposed to distinguish female criminality based on anatomical and biological data that could set women and men apart. With the development and the influx of the gender paradigm into the scope of science, so emerged the understanding that gender, what it is to be a woman, is the result of a social construct, unrelated to sex as biological input. Within the purview of critical criminology, the incorporation of this construction by feminist thinkers from the seventies has allowed for the study of women criminalisation under a distinct viewpoint, taking into consideration, overall, the different processes of socialisation to which men and women are subjected and the performance of informal instances of social control turned primarily to women. In light of these new formulations, inserted in the scope of feminist criminologies, it was possible to investigate the criminalisation of women and the socio-juridical profile of imprisoned women in Porto Alegre, built upon data made available by public institutions in the sector. The results, joined with the theoretical study presented initially, have enabled a broadening in the comprehension of the insertion of women into drug traffic structures and the visualisation of how the selection of women by the penal system has altered other characteristics of the female prison population.
