dc.description.abstract | A migração é responsável por importantes reconfigurações políticas, sociais e econômicas na sociedade atual. No Brasil a situação jurídica dos estrangeiros é regulamentada pelo Estatuto do Estrangeiro (Lei 6.815/80) cujos dispositivos apresentam uma linha ideológica voltada para a preocupação com a segurança nacional. No continente americano existe um sistema regional de proteção aos direitos humanos: o Sistema Interamericano de Direitos Humanos, cujo órgão jurisdicional é a Corte Interamericana de Direitos Humanos, com competência contenciosa e consultiva. Utilizando essa competência consultiva, o México solicitou um parecer que deu origem à opinião consultiva OC—18/03 da Corte Interamericana de Direitos Humanos. Essa sentença reforçou a obrigação de respeitar e assegurar os direitos fundamentais, incluindo o direito ao devido processo legal e os direitos trabalhistas, independentemente de status migratório dos indivíduos. Também reforçou a importância do princípio da igualdade e da não - discriminação para a proteção dos direitos humanos, que passaram para o domínio do jus cogens. | pt_BR |
dc.description.abstract | Migration is responsible for important political, social and economic reconfiguration in present society. In Brazil, the legal situation of foreigners is regulated by the statute of foreigners (Act 6.815/80) whose devices feature an ideological line facing the concern for national security. In the American continent there is a regional system of human rights protection: the Inter-American system of human rights, whose jurisdictional organ is the Inter-American Court of Human Rights, with contentious and advisory jurisdiction. Using this consultative competence, Mexico requested an opinion that gave rise to advisory opinion OC-18/03 of the Inter-American Court of Human Rights. This ruling reinforced the obligation to respect and ensure the fundamental rights, including the right to due process of law and labor rights regardless of immigration status of individuals. Also reinforced the importance of the principle of equality and non-discrimination for the protection of human rights, which passed to the domain of jus cogens. | en |
