dc.description.abstractA pesquisa, elaborada pelo método teórico-comparativo ou analítico-conceitual, mediante a análise dos escritos legislativos, doutrinários e jurisprudenciais acerca da temática sobre a qual se debruça, almeja, em primeiro plano, analisar os limites do controle judicial sobre a convenção de arbitragem. O objetivo é, portanto, esclarecer o âmbito de atuação franqueado ao Poder Judiciário sobre o controle da convenção de arbitragem, analisando as excepcionalíssimas hipóteses em que se deve autorizar ao juiz estatal a declaração da invalidade do pacto arbitral, relativizando, assim, os princípios da separabilidade da cláusula arbitral e da competênciacompetência. Para tanto, a pesquisa foi dividida em três partes. Na primeira, buscouse uma retomada histórica dos meios alternativos de resolução de conflitos, conhecidos pelo termo alternative dispute resolution, e da evolução do instituto da arbitragem na legislação brasileira, uma vez que para compreender o estágio atual do direito é necessário voltar os olhos ao seu devir histórico. Na segunda parte, analisou-se mais especificamente a convenção arbitral, com foco na sua previsão legal, nos seus requisitos e na diferenciação entre cláusula arbitral e compromisso arbitral. Ainda na segunda etapa da pesquisa, realizou-se uma análise comparativa entre os princípios da separabilidade da cláusula de arbitragem e da competênciacompetência com o princípio da inafastabilidade do Poder Judiciário, com vistas a firmar a constitucionalidade do juízo arbitral. Por último, mas não menos importante, foram apresentadas as raríssimas hipóteses em que se deve admitir a apreciação pelo juiz estatal, antes do árbitro, das questões atinentes à existência, à validade ou à eficácia da convenção de arbitragem.pt_BR
dc.description.abstractThe study, prepared by the comparative and theoretical method or conceptual and analytical method, through the analysis of written legislation, doctrine and jurisprudence on the researched theme, aims, in the foreground, to analyze the limits of judicial review of the arbitration agreement. The goal is therefore to clarify the scope of work assigned to the Judiciary about the arbitration agreement control, analyzing the assumptions on which the state judge must authorize the nullity declaration of the arbitration agreement, relativizing thus the separability concept the Competence-Competence principle. Therefore, the research was divided in three parts. At first, we elaborated a historic retaking about the alternative dispute resolution and about the evolution of the arbitration concept in Brazilian law, because to understand the current state of law is necessary to turn our eyes to the historical development. In the second part, we analyzed specifically the arbitration agreement, focusing on its legal provision, on its requirements and on differentiate types of arbitration agreement. Even in the second stage of the research, we carried out a comparative analysis of the separability concept, the Competence-Competence principle and the Judiciary obrigatory role, in order to establish the arbitration constitutionality. Last but not least, we presented the rare cases in which it must be admitted to examination by the state judge, before the referee, the issues relating to the arbitration agreement existence, validity or effectiveness.en
