dc.description.abstractMesmo com a previsão do artigo 120 da Lei nº 8.213, desde o ano de 1991, o qual prevê que nos casos de negligência quanto às normas padrão de segurança e higiene do trabalho indicados para a proteção individual e coletiva, a Previdência Social proporia ação regressiva contra os responsáveis. Apenas a partir de 2009, com a intensificação do ajuizamento das ações regressivas acidentárias por parte da Procuradoria-Geral Federal, é que o tema ganhou amplitude, passando a ser mais debatido em nossa doutrina. A principal divergência no que se refere à procedência ou não destas ações regressivas refere-se à constitucionalidade do art. 120 da Lei nº 8.213/91 e ao debate entre a tese das empresas, as quais alegam enriquecimento ilícito do INSS ao cobrar por algo que já foi pago e à tese da PGF, a qual defende a ação regressiva como possibilidade de restituição ao erário e como medida pedagógica de prevenção de acidentes laborais. Este trabalho discute acerca da possibilidade do ajuizamento das ações regressivas acidentárias e quais suas implicações. Apresenta o conceito e as noções gerais de acidente do trabalho, o dever do empregador quanto à saúde do empregado, a definição e os pressupostos para o ajuizamento das ações regressivas acidentárias, a polêmica que envolve o assunto, bem como a análise de jurisprudência de ambas as teses. Ao final, conclui-se que a jurisprudência adota, majoritariamente, a tese de que, em casos de acidentes de trabalho decorrentes de negligência quanto à adoção das normas de segurança do trabalho, os responsáveis devem responder em ação regressiva perante a Previdência Social.pt_BR
dc.description.abstractEven with the requirements of the Article 120 of the Law 8.213, since the year of 1991, which foresees that in cases of negligence as to the standard rules of safety and hygiene at work indicated for individual and collective protection, Social Security would propose a regressive action against the responsible. Only from 2009 on, with the intensification of the prosecution of regressive actions related to accidents by the Federal Attorney General, this theme has gained amplitude, becoming more discussed in out doctrine. The main divergence refers to the precedence or not of these regressive actions refers to the constitutionality of the Article 120 of the Law 8.213/91, and the debate between the thesis of the companies - which allege embezzlement by Social Security by charging something that has already been paid – and the thesis of the PGF, which defends the regressive action as a possibility to refund the state treasury and as a pedagogical prevention of accidents at work. This paper discusses the possibility of the filing of the regressive actions and their implications. It presents the concept and the notions of work accidents, the duty of the employer with the employee health, the definition and the assumptions for the filing of the regressive actions related to accidents, the controversy that surrounds the subject, as well as the analysis of the jurisprudence of both theses. At the end of this paper, it is concluded that the jurisprudence adopts, mainly, the thesis that, in cases of work accidents caused by the negligence on the adoption of the standard rules of safety, the responsible must answer in regressive action before the Social Security.en
