O presente trabalho tem por fim analisar a situação atual do processo transicional brasileiro. Sob a ótica da Justiça de Transição e seus pilares, faz-se uma análise dos progressos obtidos no campo transicional pátrio, demonstrando que a Justiça de Transição brasileira alicerçou-se na dimensão da reparação. Não obstante, diante da existência de quatro pilares que sustentam a Justiça de Transição – reforma e consolidação das instituições democráticas, busca pela verdade, reparação às vitimas e responsabilização ou implementação de medidas de justiça – o Brasil demonstra grande dificuldade em implementar políticas que visem a completude do processo de transição, tendo obtido avanços significativos somente no plano da reparação às vitimas. Com efeito, principalmente em relação à dimensão da responsabilização, a Lei de Anistia (6.683/79) e a intepretação reiterada pelo Supremo tribunal Federal constitui, atualmente, o maior obstáculo para o alcance de uma Justiça Transicional completa. Comparado aos países vizinhos, como Argentina, o Brasil apresenta uma Justiça de Transição anêmica, voltada ao esquecimento e à impunidade. Com base no Direito Internacional, observa-se que a postura adotada pelo Estado brasileiro no sentido de manter uma lei de anistia que gera impunidade e nega às vítimas o direito à justiça, vai de encontro à jurisprudência internacional, principalmente da Corte Interamericana de Direitos Humanos, cuja competência jurisdicional o Brasil reconheceu em 1988. Assim, a análise dos rumos do processo transicional brasileiro, bem como da decisão do Supremo Tribunal Federal à luz da jurisprudência internacional, assume papel central neste trabalho. ...
Abstract
The present study aims an analysis of the Brazilian current transitional process. The present study aims an analysis of the Brazilian current transitional process. From the viewpoint of the Transitional Justice and its basic directives, an analysis has been made from several cases in the field of nacional transicional, showing an upcoming tendency of the Justice to deliberate in the direction of repair. Nevertheless, taking the four basic pillars of the Transition Justice – them being: reform and consolidation of democratic institutions; search for the truth of events and facts; indemnification of victims; accountability of happenings or implementing justice measures – the Government showed a lack of accomplishment implementing policies toward the transition process’ goals, only having advancements regarding indemnification of victims. The Amnesty Law (6.683/79) and its interpretation regarding the dimensions of accountability by the Supreme Court is consider to be the biggest hindrance to achieve excellence in transitional justice. Compared with other South American countries, such as Argentina, Brazil’s Transitional Justice becomes easily classified as ill-founded, focused in oblivion and impunity. Based on International Law, it is visible the posture adopted by the Brazilian Government of maintaining an impunity amnesty law which unable victims to seek and achieve proper justice goes against the international jurisprudence, especially against the Inter-American Court of Human Rights, which its jurisdiction is recognized and well-known by the Brazilian government since 1988. Therefore, analysis of the tendencies of several process of transitional justice and the decisions made by the Supreme Court in such cases, focus on internacional jurisprudence, is the main goal/focus of the present Project. ...
