A presente monografia tem como propósito apontar a inconstitucionalidade do art. 6º da Lei 9.601/98, que introduziu no ordenamento jurídico o sistema de compensação de jornada conhecido como banco de horas. A presente monografia tem como propósito apontar a inconstitucionalidade do art. 6º da Lei 9.601/98, que introduziu no ordenamento jurídico o sistema de compensação de jornada conhecido como banco de horas. A invalidade sustentada se funda na violação ao princípio da dignidade da pessoa humana, insculpido no art. 1º da Constituição Federal, em razão dos riscos causados à saúde e à segurança do empregado que se submete à compensação anual trazida à tona pela inovação legislativa. Sob um enfoque protetor dos direitos mínimos do trabalhador, observa-se a existência de limites à flexibilização das normas trabalhistas, inclusive quando levada a cabo pela atuação dos sindicatos no seio da negociação coletiva. Nesse compasso, a dilação excessiva do parâmetro temporal máximo em matéria de compensação de jornada, embora constitua medida favorável aos interesses empresariais, pois reduz o pagamento de adicional de horas extras aos empregados, não encontra respaldo constitucional, dados os danos físicos, psicológicos e sociais provocados aos obreiros que se expõem a consecutivas jornadas de trabalho em regime extraordinário. ...
