Concurso de pessoas no infanticídio

Abstract

Esta monografia teve por objetivo principal a busca pela solução da problemática relacionada à questão da comunicabilidade da elementar "sob a influência do estado puerperal" na realização do crime de infanticídio quando executado pela mãe em concurso com terceiro, uma vez que este, em plena capacidade mental e física, acaba por receber a benesse da pena abrandada de tal tipo se em comparação à pena de homicídio, delito pelo qual deveria responder por não apresentar o estado fisiopsicológico alterado exigido pelo texto do artigo 123 do Código Penal. Partindo de uma análise acerca do que é infanticídio e puerpério — juntamente de seus efeitos subjacentes —, estabeleceu-se a teoria formal-objetiva do concurso de agentes como o pressuposto ideal para se selecionar a corrente doutrinária mais condizente com a realidade dos fatos e de nosso ordenamento jurídico sobre a questão. E, partindo disso, concluiu-se que, apesar de serem aqueles que defendem a total incomunicabilidade da influência do estado puerperal mais justos e corretos para com a moralidade, incabível seguir entendimento que não aquele que clama pela total comunicabilidade de tal elementar. Por fim, observando a presença de falhas em todas as correntes doutrinárias estudadas, sugeriu-se, para uma solução futura mais duradoura e ideal, a alteração legislativa do infanticídio, inserindo-o ao corpo do artigo 121, como homicídio privilegiado, ou integrando a seu próprio texto um parágrafo único, determinando que aqueles que concorrem com a mãe respondam pelas penas cominadas no tipo penal de homicídio.

This monograph had had by main objective the search of the solution for the problematic related to the "under the influence of the puerperal state" elemental communicability question in the consummation of the infanticide's crime when executed by the mother in concourse with a third person, once this third person, in its full mental and physical capacity, receives the bounty of the type's softened penalty if in comparison to the penalty of homicide, misdemeanor whereby it shouid respond by not presenting the amended physiopsychological state required by the text of the 123 article of the Penal Code. Starting with an analysis of what is infanticide and postpartum — along their underlying effects — it was established the formal-objective theory of the people's concourse as the ideal assumption to seiect the doctrinal chain more suited to the reality of the facts and of our legal system on the issue. And, from that, it was concluded that, although being those who defend the total lack of communicability from the influence of the puerperal state more just and right toward morality, it's not possible to follow an understanding different than that which claims for the total communicability of such elemental. Finally, noting the presence of flaws in all the studied doctrinal chains, it was suggested for a future solution more durable and ideal, the legislative amendment of infanticide, inserting it into the body of the article 121 as privileged homicide, or integrating to its own text a single paragraph stating that those who concourse with the mother get condemned by the penalties stipulated in the homicide's penal type.
