Negociação coletiva no setor público federal : estudo com os formandos do curso promovido pela UFRGS - turmas de São Paulo

Abstract

A inserção da negociação coletiva no procedimento legislativo para o setor público é matéria que tem se destacado nas pautas de reivindicações das entidades representativas da categoria dos Servidores Públicos Federais. Considerando os artigos: 8º incisos I; III; VI e 37º incisos VI e VII, da CRFB, a instituição da MNNP em 2003, a ratificação pelo Congresso Nacional em 2010, da Convenção 151 da OIT, combinado com ações governamentais no âmbito da Administração Pública Federal, tais como a realização do Curso de Especialização em Negociação Coletiva no Setor Público, têm-se a seguinte questão: como os futuros especialistas, das turmas de São Paulo do curso promovido pela UFRGS, se posicionam a respeito de diferentes aspectos constitutivos da Negociação Coletiva? Trata-se de um estudo quantitativo descritivo, baseado em pesquisa de campo. O estudo evidenciou que 73,7% dos respondentes concordam totalmente e 26,3% concordam em parte que a regulamentação da negociação coletiva no serviço público federal é imprescindível para a implementação permanente da negociação coletiva no setor público. Quanto à inserção da Convenção 151 da OIT no ordenamento jurídico brasileiro como variável essencial para o processo de regulamentação da Negociação Coletiva no Serviço Público Federal, o estudo demonstra que 89,5% dos respondentes concordam totalmente e 10,5% concordam em parte. Dessa forma, o estudo aponta para mudanças legislativas e culturais, como subsídios para que haja negociação coletiva no setor público.

The insertion of collective bargaining in the legislative procedure for the public sector is a subject that has stood out among the claims of federal public servant unions. Concerning the articles 8th subsections I; III; VI and 37th subsections VI and VII, of CRFB, the institution of the MNNP in 2003, the ratification by the National Congress in 2010, of Convention 151 of OIT, combined with governmental actions in the ambit of Federal Public Administration such as the achievement of the Graduate Specialization in Collective Bargaining in the public sector course, have the following question: how future specialists, the classes of St. Paul of the course organized by UFRGS, stand about different aspects that constitute the collective bargaining? This is a descriptive quantitative study, based on field research. The study showed that 73.7% of respondents strongly agree and 26.3% partly agree that the regulation of collective bargaining in the federal public service is essential to continuing the implementation of collective bargaining in the public sector. As for the insertion of the OIT Convention 151 on the Brazilian legal system as an essential variable to the regulatory process of collective bargaining in the Federal Public Service, the study shows that 89.5% of respondents strongly agree and 10.5% partly agree. The study points to legislative and cultural changes, as there are subsidies for collective bargaining in the public sector.
