Este trabalho visa apresentar em linhas gerais um dos fatores-chave para a corrosão da impunidade frente aos “fenômenos” das ditaduras militares – mais especificamente o caso chileno – que tiveram lugar na América Latina na segunda metade do século XX. O processo aberto na justiça espanhola contra Augusto Pinochet e outros repressores não só representou uma ameaça à impunidade do general, mas também foi determinante para estabelecer a sinonímia universal que identificou Pinochet à crueldade, à arbitrariedade, à traição e à ignomínia. O texto apresenta os elementos que polarizaram as forças sociais chilenas e que desembocaram no golpe de Estado de 11 de setembro de 1973 e que iniciou uma ditadura que se prolongou até março de 1990. Pinochet, ao deixar o poder formal do Chile, continuou mantendo o controle das Forças Armadas e grande influência sobre o poder civil. Com esses subsídios, analisaremos o juízo espanhol contra Pinochet e justificaremos por que foi emblemático do ponto de vista da ameaça à impunidade e significativo para o avanço do Direito Internacional no que concerne aos crimes contra a Humanidade. ...
