Lide simulada na justiça do trabalho

Abstract

Esta monografia versa sobre a lide simulada no âmbito da Justiça do Trabalho. Em um primeiro momento, serão analisados conceitos fundamentais na compreensão do tema, quais sejam: o acesso à justiça, o conceito de lide e o processo como busca da paz social. Em seguida, discorre-se sobre o princípio da boa-fé e a litigância de má-fé. Por fim, serão abordadas as diversas modalidades de lide simulada, bem como as conseqüências dessa prática e eventuais sugestões para o problema.

The present study is about simulated litigation within Labour Courts. At first, we will analyze the fundamental concepts in the understanding of the subject, namely: access to justice, the concept of litigation and process as the search for social peace. Secondly, the study turns to the analysis of the principles of good faith and bad faith. Finally, we will discuss the different types of simulated litigation, as well as the consequences of this practice and the suggestion for solving the problem.
