Direito autoral na sociedade da informação

Abstract

O presente trabalho visa analisar a situação atual do direito autoral, em face da revolução digital e da sociedade da informação. Busca estabelecer um panorama geral do direito autoral por meio do estudo de sua evolução histórica através de diferentes épocas e sociedades. Destaca a dicotomia entre os direitos morais e patrimoniais, característica marcante do direito autoral e responsável pela sua natureza diferenciada. Dispõe acerca dos princípios que constituem ambos os grupos, com o objetivo de melhor compreender a importância da proteção do autor como forma de incentivar a criação intelectual e o desenvolvimento humano. Explora a questão do surgimento da internet e do mundo digital e de seus impactos na difusão de informação e na proteção autoral. Apresenta possíveis alternativas para adequar o direito autoral ao século XXI, como é o caso da iniciativa Creative Commons.

This work aims to analyze the current state of copyright, in view of the digital revolution and the information society. It seeks to establish an overview of copyright with the study of its historical development through different times and societies. It highlights the dichotomy between the moral and property rights, a typical feature of author rights which is responsible for its unique nature. It lays out the principles which constitute both groups, in order to better understand the importance of protecting authors as an incentive to intellectual creation and human development. It explores the issue regarding the emergence of the Internet and the digital world and their impacts on the dissemination of information and author rights protection. It displays alternatives to suit the authorial rights to the twenty-first century, as is the case of the Creative Commons initiative.
