Patrimônio documental da humanidade e direitos sociais homoafetivos : processos da Justiça Federal do Rio Grande do Sul como memória do mundo pela UNESCO em 2015

Abstract

A UNESCO conferiu o título de Patrimônio Documental da Humanidade a dois processos judiciais jugados pela Justiça Federal do Rio Grande do Sul que versavam sobre os direitos sociais dos casais homoafetivos. Um destes processos, julgado em 1996, exigia a admissão de parceiro de união homoafetiva em fazer parte do plano de saúde do companheiro, enquanto o outro, julgado em 2000, demandava a autorização de casais homoafetivos em receber benefícios previdenciários de seu companheiro. O reconhecimento deste acervo documental como Patrimônio Documental da Humanidade serviu como paradigma para outras decisões subsequentes, ampliando o acesso dos homossexuais a direitos até então não permitidos a eles. A metodologia aplicada neste trabalho deu-se através da análise dos processos judicias em comento, bem como por meio do exame de artigos de autores com pesquisas nas áreas de Direito, História e de Patrimônio Cultural, como Tony Boita e Jean Baptista. A qualificação como Patrimônio Documental destes dois processos judiciais auxiliou na pretensão de superação da cultura de apagamento sofrida pelos patrimônios LGBTQIA+ nos espaços destinados à memória, servindo como forma de construir uma identidade coletiva deste grupo. Através deste trabalho, busca-se compreender as implicações de ver estes processos judiciais não apenas como fontes históricas, mas como Patrimônios Documentais da Humanidade. Atribuir a estes processos judiciais o título de patrimônio não serve apenas como forma de conferir um viés histórico às suas conquistas, mas também atua de forma ativa para a preservação da vida de toda a comunidade LGBTQIA+, uma vez que a defesa da vida é a finalidade da patrimonialização.

UNESCO has granted the title of Documentary Heritage of Humanity to two lawsuits heard by the Federal Court of Rio Grande do Sul that dealt with the social rights of same-sex couples. One of these lawsuits, judged in 1996, required the admission of a same-sex partner to be part of their partner's health plan, while the other, judged in 2000, demanded the authorization of same-sex couples to receive social security benefits from their partner. The recognition of this documentary collection as Documentary Heritage of Humanity served as a paradigm for other subsequent decisions, expanding access for homosexuals to rights that were previously not granted to them. Through the analysis of the judicial proceedings in question, as well as through the examination of articles by authors with research in the areas of Law, History and Cultural Heritage, such as Tony Boita and Jean Baptista. The qualification of these two judicial proceedings as Documentary Heritage helped in the attempt to overcome the culture of erasure suffered by LGBTQIA+ heritage in spaces destined for memory, serving as a way of building a collective identity for this group. Through this work, i seek to understand the implications of seeing these legal proceedings not only as historical sources, but as Documentary Heritage of Humanity. Attributing the title of heritage to these judicial proceedings not only serves as a way of giving a historical bias to their achievements, but also actively acts to preserve the lives of the entire LGBTQIA+ community, since the defense of life is the purpose of patrimonialization.
