Transferência internacional de dados pessoais : as cláusulas-padrão contratuais na União Europeia e no Brasil

Abstract

O presente trabalho trata sobre a transferência internacional de dados pessoais no Regulamento Geral sobre a Proteção de Dados (RGPD) e na Lei Geral de Proteção de Dados (LGPD), especificamente, no que diz respeito à regulamentação e à utilização das Cláusulas-Padrão Contratuais (CPCs) na União Europeia e no Brasil. Apresenta-se como pergunta norteadora: como os desdobramentos do caso Schrems II impactarão na elaboração das CPCs por parte da Autoridade Nacional de Proteção de Dados (ANPD)? O objetivo geral é entender como os desdobramentos do caso Schrems II impactarão na elaboração das CPCs por parte da ANPD. Partiu-se da hipótese de que a ANPD irá considerar e analisar os quesitos analisados pelo Tribunal de Justiça da União Europeia (TJUE), considerando-os na medida de sua compatibilidade com a LGPD. Constatou-se que as novas CPCs elaboradas pela Comissão Europeia, após a decisão do TJUE, são modelos adequados a serem seguidos pela ANPD, desde que sejam respeitadas as especificidades da legislação brasileira.

The present research deals with the international transfer of personal data in the General Data Protection Regulation (GPDR) and the General Data Protection Law (LGPD), specifically about the regulation and use of Standard Contractual Clauses (SCCs) in the European Union and Brazil. It is presented as a guiding question: how will the developments of the Schrems II case impact the elaboration of SCCs by the Brazilian National Data Protection Authority (ANPD)? The general objective is to understand how the unfolding of the Schrems II case will impact the elaboration of SCCs by the ANPD. It started from the hypothesis that the ANPD will consider and analyze the issues analyzed by the Court of Justice of the European Union (CJEU), considering them to the extent of their compatibility with the LGPD. It was found that the new SCCs elaborated by the European Commission, after the decision of the CJEU, are suitable models to be followed by the ANPD, respecting the differences brought by Brazilian legislation.
