dc.description.abstract | O trabalho enfoca a temática do reconhecimento do afeto como valor jurídico para o Direito de Família contemporâneo. Isso porque o modelo familiar, antes da Constituição Federal de 1988 e na vigência do Código Civil de 1916, era predominantemente o patriarcal, em que o pai, como chefe da instituição, tinha função econômico-produtiva, além de ser vinculado ao laço sanguíneo existente entre os pais e o(s) filho(s). A proteção jurídica era direcionada à instituição família como um todo. Após a promulgação da Constituição de 1988 e suas disposições fundamentais, uma nova moldura familiar foi criada, em que prevalecem os laços de afeto, e não somente o biológico, gerando uma nova perspectiva lato sensu acerca da mutabilidade do conceito familiar e stricto sensu no que concerne à percepção da filiação nesse aspecto. Por certo que esse descompasso entre as normas legais e a realidade que abarca o Direito de Família faz surgir inúmeras situações que precisam ser resolvidas no âmbito judicial, sem haver amparo legal e discussão suficiente. Dentre elas, ergue-se a necessidade de analisar como, por exemplo, a filiação socioafetiva vem sendo aplicada, diferenciada e tratada pelo ordenamento jurídico, de acordo com seus requisitos, bem como outras situações que permeiam o afeto, como o abandono afetivo e a responsabilidade civil decorrente. Assim, tomou-se como objetivo analisar como têm ocorrido os avanços jurisprudenciais e as construções doutrinárias acerca da admissão de novas entidades familiares e da percepção do afeto no ordenamento jurídico, haja vista o atraso legislativo nesse sentido. Como resultado, percebe-se, através da posição da jurisprudência, que é inegável que o afeto é elemento essencial para configurar a relação das famílias, tanto para o reconhecimento e garantia do respeito de novas entidades familiares - como o reconhecimento das relações homoafetivas e multiparentais -, bem como para o reconhecimento da filiação para além do vínculo biológico, a partir da posse de estado de filho e o reconhecimento social dessa filiação contínua e duradoura, de modo que, para além de efeitos registrais e patrimoniais, há a submissão ao poder familiar do reconhecido, a fim de que se garantam carinho, amor, aconchego e todos outros direitos inerentes a um ser. Assim, o entendimento a que se chegou no presente trabalho consubstancia-se na ideia de que, embora a Constituição Federal de 1988, o Judiciário e a doutrina tenham dado maior importância jurídica ao instituto do afeto, ao ponto de considerá-lo como princípio, o casamento arcaico continua sendo o centro das normas infralegais, causando descompasso. Conquantos provimentos do Conselho Nacional de Justiça nesse sentido, conclui-se que a filiação deve ter maior resguardo e vista sob a ótica das relações de responsabilidade emocional e financeira, independentemente de sua origem, cabendo ao Estado garantir a ampla proteção aos envolvidos, uma vez que, embora todos tenham direito à verdade biológica, não se pode negar os efeitos do vínculo duradouro e contínuo da relação de socioafetividade. Em síntese, deve ser preocupação constante do Judiciário, do Legislativo – e da doutrina igualmente – cooperarem para discutirem e realizarem políticas que efetivem o princípio da afetividade, reconhecendo que é preciso normatizar ainda mais as relações que nascem fora do casamento e da consanguinidade. | pt_BR |
dc.description.abstract | The work focuses on the theme of the recognition of affection as a legal value for contemporary Family Law. This is because the family model, before the Federal Constitution of 1988 and when the Civil Code of 1916 was in validity, was predominantly patriarchal, in which the father, as head of the institution, had an economic-productive function, besides being linked to the blood tie existing between the parents and the children. The legal protection was directed to the family institution as a whole. After the enactment of the 1988 Constitution and its fundamental provisions, a new family framework was created, in which bonds of affection prevail, and not just the biological one, generating a new lato sensu perspective about the mutability of the family concept and stricto sensu in what concerns the perception of affiliation in this aspect. Certainly, this mismatch between legal norms and the reality that encompasses Family Law gives rise to numerous situations that need to be resolved in the judicial sphere, without having sufficient legal support and discussion. Among them, there is a need to analyze how, for example, socio-affective affiliation has been applied, differentiated and treated by the legal system, in accordance with its requirements, as well as other situations that permeate affection, such as emotional abandonment and resulting civil liability. Thus, the objective was to analyze how jurisprudential advances and doctrinal constructions have occurred regarding the admission of new family entities and the perception of affection in the legal system, given the legislative delay in this regard. As a result, it can be seen, through the position of jurisprudence, that it is undeniable that affection is an essential element to configure the relationship of families, both for the recognition and guarantee of respect for new family entities - as well as the recognition of homoaffective and multiparental relationships -, as well as for the recognition of affiliation beyond the biological bond, from the status and the social recognition of this continuous and lasting affiliation, so that, in addition to registration and patrimonial effects, there is submission to power recognized, in order to guarantee affection, love, warmth and all other rights inherent to a being. Thus, the understanding reached in the present work is based on the idea that, although the Federal Constitution of 1988, the Judiciary and the doctrine have given greater legal importance to the institute of affection, to the point of considering it as a principle, archaic marriage continues to be the center of infralegal norms, causing mismatch. While provisions of the Superior Tribunal of Justice in Brazil in this regard, it is concluded that affiliation must be more protected and seen from the perspective of emotional and financial responsibility relationships, regardless of their origin, and it is up to the State to guarantee broad protection to those involved, since that, although everyone has the right to the biological truth, the effects of the lasting and continuous bond of the socio-affective relationship cannot be denied. In summary, it must be a constant concern of the Judiciary, the Legislature – and the doctrine alike – to cooperate to discuss and carry out policies that implement the principle of affectivity, recognizing that it is necessary to regulate even more the relationships that are born outside of marriage and consanguinity. | en |
