O novo mercado de vídeo sob demanda (VoD) está instalado no Brasil desde 2011, e a sociedade brasileira discute há pelo menos uma década os pormenores da sua regulação. Existem hoje cinco projetos de Lei em tramitação na Câmara e no Senado que evocam o tema. Das inúmeras diferenças entre os respectivos Projetos de Lei, um tópico é unanimidade: a instituição de recolhimento da Contribuição para o Desenvolvimento da Indústria Cinematográfica Nacional (CONDECINE) para as operadoras de VoD. Este artigo discute as diferentes alíquotas propostas em cada projeto de lei e realiza análises estatísticas sobre os impactos econômicos da Lei n. 12.485/2011. Analisa em particular o impacto dos recursos executados pelo Fundo Setorial do Audiovisual (FSA) após a referida Lei, entre os anos de 2012 e 2019, sobre as variáveis: valor adicionado do audiovisual e número de agentes registrados na Agência Nacional do Cinema (ANCINE). Após a aplicação de modelos de regressão linear bivariada, as inferências estatísticas levantadas apontam que houve aumento significativo nas duas variáveis de interesse na comparação entre antes e depois da Lei. E que também houve influência significativa dos valores aportados pelo FSA sobre ambas. Superada essa etapa, o artigo buscou determinar quais os potenciais e os hipotéticos impactos econômicos sobre as mesmas variáveis de interesse em cenário de regulação do VoD e de recolhimento da Condecine sobre esse segmento no ano de 2021, mobilizando duas simulações distintas com base nas alíquotas previstas nos projetos de lei: 3 e 20%. Concluiu-se que o montante que o Estado brasileiro deixou de arrecadar com a Condecine-VoD em 2021 foi de pelo menos R$138 milhões, podendo chegar a quase R$1 bilhão, no caso de alíquota máxima prevista. Concluiu-se ainda que, em análise hipotética, o crescimento no número de agentes registrados em 2021 poderia ser no mínimo 86% maior, podendo alcançar um incremento máximo de até 96,5%. ...

The new video-on-demand (VoD) market has been set in Brazil since 2011, and Brazilian society has been discussing the details of its regulation for at least a decade. There are currently five bills pending in the House and Senate that address the issue. Of the numerous differences between the respective bills, one topic reaches unanimity: collecting a Contribution for the Development of the National Film Industry (CONDECINE) duty for VoD operators. This article discusses the different duty rates proposed in each bill, and performs statistical analyzes on the economic impacts of Law 12,485/2011. In particular, it analyzes the impact of the flows disbursed by the Audiovisual Sectorial Fund (ASF) after the aforementioned Law, between the years 2012 and 2019, on the variables: audiovisual added value and the number of agents registered with the National Film Agency (ANCINE). After applying bivariate linear regression models, the statistical inferences raised point to a significant increase in the two variables of interest in a comparison between before and after the Law. And that there was also a significant influence of the amounts contributed by the FSA on both. Having overcome this stage, the article sought to determine the potential and hypothetical economic impacts on the same variables of interest in a scenario of VoD regulation and Condecine duty collection on this segment in 2021, mobilizing two different simulations based on the predicted rates in bills: 3 and 20%. It was concluded that the amount that the Brazilian State failed to collect with Condecine-VoD in 2021 was at least R$138 million, and could reach almost R$1 billion, in the case of the maximum expected rate. It also concluded that, in a primary hypothetical analysis, the growth in the number of registered agents in 2021 could be at least 86% higher, reaching a maximum growth of up to 96.5%. ...
