Abstract in Portuguese (Brasil)
Este artigo tem como objetivo principal a análise do sistema de arbitragem. Na primeira parte analisa o seu histórico mundial e o seu histórico no direito brasileiro. Na segunda parte o trabalho analisa a constitucionalidade do instituto da arbitragem e, brevemente, o seu uso no direito administrativo e no direito tributário. Conclui que os benefícios da sua utilização refletem em uma diminuição de litígios na esfera judicial.
Abstract
This article has as main objective the analysis of the system of arbitration. In the first part analyzes the world history and the Brazilian history. In the second part, the paper analyzes the constitutionality of the arbitration institute and the use inside administrative law and tax law. It is concluded that the benefit causes a significant decrease of law suits in judicial sphere.
