Direito civil constitucional : o pensamento tópico como proposta metodológica

Abstract

O processo de subsunção está ligado à aplicação do direito. Exige-se, conforme a tese firmada por Tércio Ferraz, a constatação de que o sentido da norma coaduna-se com a interpretação, que em último caso não se confunde com a aplicação. O presente trabalho prima evidenciar o “Giro Hermenêutico Interpretativo” no âmbito da codificação civil, o qual reconhece a efetiva ascensão dos direitos fundamentais, o reconhecimento do culturalismo jurídico e a tridimensionalidade do direito. Pela conjugação das novas construções jurídicas, o trabalho demonstrará o processo de subsunção envolvido na ontognoseologia jurídica, teoria construída por Miguel Reale, na aplicação do direito, marcadas por valores dos juízes e da sociedade (aproximação entre moral e direito), ultrapassando o mero automatismo da razão jurídica positiva, que impõe a lógica da dedução e desconsidera os fatos que tangenciam a situação fática. Será demonstrado o caráter epistemológico das decisões no âmbito privado, posto haver a supremacia da tese da diferença intrínseca ao aplicar métodos de interpretação próprios para enfrentar alguns conflitos jurídicos, distanciando-se do automatismo lógico da dedução, ainda vigente na aplicação do direito brasileiro, igualmente, revela-se novos topoi ao fundamentar a discussão jurídica num compromisso democrático, deslocando a fundamentação das decisões judiciais para a construção criadora do direito.

The subsumption process is linked to the application of law. It is required, according to the thesis signed by Tércio Ferraz, the verification that the meaning of the norm is consistent with the interpretation, which in the last case is not confused with the application. The present work emphasizes the "Interpretive Hermeneutic Turn" in the scope of civil codification, which recognizes the effective rise of fundamental rights. Through the combination of new legal constructions, the work will demonstrate the process of subsumption involved in legal ontognoseology, a theory built by Miguel Reale, in the application of law, marked by values of judges and society (approximation between morality and law), surpassing mere automatism. of positive legal reason, which imposes the logic of deduction and disregards the facts that touch the factual situation. The epistemological character of decisions in the private sphere will be demonstrated, since there is the supremacy of the thesis of intrinsic difference when applying its own interpretation methods to face some legal conflicts, distancing itself from the logical automatism of deduction, still in force in the application of Brazilian law, equally , reveals itself as a new topoi by basing the legal discussion on a democratic commitment, shifting the reasoning of judicial decisions to the creative construction of law.
