A interpretação qualitativa da legítima como forma de proteção dos vulneráveis e os mecanismos disponíveis na estrutura jurídica brasileira aplicáveis à sua efetivação

Abstract

A presente pesquisa tem como objetivo analisar os mecanismos disponíveis na estrutura jurídica brasileira que podem servir de proteção aos vulneráveis da família dentro do Direito Sucessório através de uma interpretação qualitativa do instituto da legítima. A abordagem do trabalho é dialética, e o método de procedimento descritivo, tendo como técnica de pesquisa a revisão bibliográfica. O trabalho é estruturado em dois itens principais. O primeiro item trata sobre a proteção dos vulneráveis no Direito Sucessório em virtude da função social da legítima a partir do princípio da solidariedade. O segundo item trata, especificamente, da interpretação qualitativa da legítima e os mecanismos disponíveis na estrutura jurídica brasileira que podem servir de proteção aos vulneráveis. A partir da pesquisa realizada, concluiu-se que a função da legítima no Direito Sucessório é de assistência familiar, mas diante das modificações nas estruturas familiares, a legítima não vem mais desempenhando totalmente seu papel, neste sentido para que a legítima volte a cumprir sua função social é preciso que o Direito Sucessório garanta a tutela dos herdeiros vulneráveis, conforme os princípios da solidariedade familiar, da dignidade da pessoa humana e da igualdade. Ainda, chegou-se à conclusão de que para efetivar a tutela dos vulneráveis no Direito Sucessório é preciso que o ordenamento jurídico brasileiro busque interpretar a legítima de forma qualitativa, e não somente quantitativa. E para que a interpretação qualitativa possa ser realizada é preciso analisar as possíveis necessidades dos herdeiros vulneráveis, e verificar os instrumentos jurídico aplicáveis ao Direito Sucessório para a proteção dos vulneráveis através da qualificação da legítima.

The present research aims to analyze the available mechanisms in the Brazilian legal structure that can serve as protection for the vulnerable of the family within the Inheritance Law, through a qualitative interpretation of the legitimate institute. The approach of the work is dialectic, and the method of descriptive procedure, having as research technique the bibliographic review. The work is structured in two main items. The first item deals with the protection of the vulnerable in Inheritance Law due to the social function of the legitimate based on the principle of solidarity. The second item deals specifically with the qualitative interpretation of the legitimate and the mechanisms available in the Brazilian legal structure that can protect the vulnerable. Based on the research carried out, it was concluded that the role of the legitimate in Inheritance Law is family assistance, but given the changes in family structures, the legitimate is no longer fully performing its role, in this sense so that the legitimate returns to fulfill its role social function it is necessary that the Inheritance Law guarantees the protection of vulnerable heirs, according to the principles of family solidarity, human dignity and equality. Still, it was concluded that in order to carry out the protection of the vulnerable in Succession Law, it is necessary that the Brazilian legal system seeks to interpret the legitimate in a qualitative way, and not only quantitatively. And so that the qualitative interpretation can be carried out, it is necessary to analyze the possible needs of vulnerable heirs, and to verify the legal instruments applicable to the Inheritance Law for the protection of the vulnerable through the qualification of the legitimate.
