Anseios punitivos na mídia e deformação da informação : uma reflexão sobre o caso Cancellier

Abstract

A presente dissertação aborda o punitivismo penal presente no discurso da mídia de massa no ato de informar o público, com foco em uma reflexão crítica a partir do Caso Cancellier, no contexto da abordagem midiática espetacular e punitivista sobre o combate à corrupção na Operação Ouvidos Moucos. A pergunta que guia a pesquisa é “em que medida a exploração midiática das investigações e acusações que envolveram o ex-reitor Luiz Carlos Cancellier de Olivo contribuíram para uma atuação do sistema de justiça criminal violadora dos direitos fundamentais?” A fim de se buscar resposta à questão, é abordada a insistência da mídia no discurso penal punitivista, posição que atende a seus próprios interesses mercadológicos e à ideologia de lei e ordem própria da configuração capitalista neoliberal atual. Ainda, é analisada a existência de uma criminalização midiática, que contribui com o fortalecimento dos anseios criminalizantes e punitivos da sociedade por meio da manipulação de narrativas quanto ao tema da criminalidade. Por fim, faz-se uma análise crítica do modo como a Operação Ouvidos Moucos foi apresentada pela mídia e conduzida pelo sistema judicial criminal, representativo de uma atuação violadora de direitos fundamentais dos investigados e acusados, o que pode ter contribuído para o suicídio do reitor Luiz Carlos Cancellier de Olivo, personagem central da referida operação policial midiática. Quanto ao referencial teórico, a pesquisa tem como fundamento teórico conhecimentos da criminologia crítica, do direito e da sociologia, em uma abordagem multidisciplinar, de forma que a articulação desses conhecimentos permita o embasamento teórico para a análise das reportagens selecionadas a respeito da Operação Ouvidos Moucos. A metodologia utilizada assenta-se na revisão e interpretação bibliográfica da literatura relacionada ao tema, além da análise crítica de reportagens selecionadas sobre a Operação Ouvidos Moucos, colhidas em diversos sites de notícias, a fim de se relacionar a abordagem midiática do caso, a atuação do sistema judicial e a violação de direitos fundamentais, especialmente o direito à presunção da inocência de investigados e acusados.

The current dissertation accosts the penal punitivism present in the mass media speech in the act of informing the public, focusing on a critical reflection over the Cancellier Case, in the context of a spectacular and criminally punitivist mediatic approach about the fight against corruption within the Operation Deaf Ears. The question that guides the research is: “On what measure did the mediatic explorations of the investigations and accusations about the former Dean Luiz Carlos Cancellier de Olivo contribute for an acting of the criminal justice system that’s violating of the fundamental rights?” In order to seek an answer to this question, we address the media’s insistence on the criminally punitivist speech, an approach that meets it’s own business interests and it’s own belief about law and order within the current neoliberal capitalist configuration. Furthermore, it’s analysed the existence of a mediatic criminology, that contributes for the strenghtening of the criminalizing and punitivist wishes of the society through the manipulation of the narratives about the topic of criminality. Lastly, there’s a critical analysis on the way Operation Deaf Ears way presented by the media and conducted by the criminal justice system, representative of how it violated the fundamental rights of the people investigated and accused, which might have contributed for the suicide of Dean Luiz Carlos Cancellier de olivo, a main character of the above mentioned Operation. About the theoretical reference, the research has as theoretical foundation knowledge of critical criminology, law and sociology, in a multidisciplinar approach, in such way that the articulation of this knowledge allows for the theoretical foundation for the analysis of the selected news reports about Operation Deaf Ears. The metodology used settles itself on the bibliographic revision and interpretation of the literature available on the subject, in addition to the critical analysis of selected news reports about Operation Deaf Ears, taken from numerous news websites, in order to bring together the mediatic approach on the case, the acting of the criminal justice system and the violation of fundamental rights, specially the right to be presumed innocent of the people investigated and accused.
