O trabalho análogo à escravidão : dos mecanismos de combate às causas para sua persistência no contexto brasileiro

Abstract

A presente monografia tem por objetivo aprofundar o debate acerca da temática do trabalho em condições análogas à de escravo no país, investigando os fatores responsáveis, direta e indiretamente, pela permanência do trabalho escravo no Brasil. Para isso, através da revisão bibliográfica e da apreciação jurisprudencial, será feita a análise da evolução da regulamentação brasileira acerca do crime de redução do trabalhador à condição análoga à de escravo - fazendo menção aos dispositivos internacionais sobre o tema - e do Artigo 149 do Código Penal, assim como do bem jurídico tutelado pelo tipo e das situações passíveis de enquadramento da conduta. Após, seguir-se-á para o exame de alguns dos mecanismos mais importantes para o combate ao trabalho escravo e, por fim, para as considerações a respeito dos aspectos e condições responsáveis pela permanência do trabalho escravo no contexto brasileiro, realizando-se assim uma breve reflexão sobre a efetividade dos instrumentos de prevenção/combate ao trabalho escravo estudados neste trabalho e as possíveis soluções para os problemas encontrados. Concluindo-se acerca da necessidade de medidas que diminuam a vulnerabilidade do trabalhador, fomentem e protejam a legislação e os mecanismos já existentes para o combate ao trabalho escravo - garantindo assim a maior punibilidade da conduta e a ação efetiva dos agentes estatais - bem como impeçam os enormes ganhos econômicos provenientes do ilícito penal.

The present Bachelor thesis has the objective of deepening the debate on the theme of work in conditions analogous to slavery in the country, investigating the factors directly and indirectly responsible for the permanence of slave labor in Brazil. For this, by means of a bibliographical review and jurisprudential appreciation, an analysis will be made of the evolution of the Brazilian regulation on the crime of reducing a worker to a condition analogous to that of a slave - making mention of the international dispositions on the theme - and of Article 149 of the Penal Code, as well as the legal good protected by the type and the situations that can be framed in this conduct. Afterwards, we will proceed to the examination of some of the most important mechanisms to combat slave labor and, finally, to the considerations regarding the aspects and conditions responsible for the permanence of slave labor in the Brazilian context, thus making a brief reflection on the effectiveness of the instruments of prevention/combating slave labor studied in this work and the possible solutions for the problems encountered. It is concluded that there is a need for measures that diminish the worker's vulnerability, promote and protect the legislation and the already existing mechanisms to combat slave labor - thus guaranteeing the greater punishability of the conduct and the effective action of state agents - as well as prevent the enormous economic gains from the criminal illicit act.
