Legítima defesa da honra em casos de feminicídio : uma análise sob a luz da ADPF nº 779

Abstract

A violência de gênero é um problema enfrentado pelas mulheres brasileiras todos os dias e está presente no país desde sua colonização, influenciando as relações sociais, as decisões políticas e, consequentemente, as leis que regem nosso sistema jurídico. Diante desse contexto histórico, surge o recurso argumentativo da legítima defesa da honra, utilizado pelas defesas de réus acusados de violência doméstica e feminicídio para justificar suas condutas com base em atitudes da mulher que não condizem com o papel a ela imposto. Partindo desses conceitos, realizou-se na presente monografia uma pesquisa exploratória, buscando estudar a evolução dos direitos das mulheres ao longo dos anos até a decisão proferida pelo Supremo Tribunal Federal (STF) na Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 779/DF, que declarou inconstitucional a tese de legítima defesa da honra, bem como descobrir em que medida a interdição da tese defensiva da legítima defesa da honra no Tribunal do Júri pelo STF tem potencial de minimizar os estereótipos de gênero contra as vítimas. Para tanto, foi utilizado o método indutivo e consultadas fontes bibliográficas e documentais. A estrutura da pesquisa considerou a evolução histórica do papel da mulher na sociedade, assim como as alterações legislativas e jurisprudenciais, objetivando compreender os fenômenos da discriminação e da violência de gênero e identificar os reflexos da recente decisão, bem como as problemáticas que ainda devem ser enfrentadas.

Gender violence is a problem faced by Brazilian women every day and it has been present in the country since its colonization, influencing social relations, political decisions and, consequently, the laws that govern our legal system. In view of this historical context, the argumentative resource of the legitimate defense of honor arises, used by the defendants accused of domestic violence and femicide to justify their conduct based on the woman's attitudes that do not match the role imposed on her. Based on these concepts, an exploratory research was carried out in this monograph, seeking to study the evolution of women's rights over the years until the decision rendered by the Federal Supreme Court (STF) in the Allegation of Non-compliance with a Fundamental Precept (ADPF) nº 779/ DF, which declared the thesis of legitimate defense of honor unconstitutional, as well as discovering tto what extent the interdiction of the defensive thesis of the legitimate defense of honor in the Jury Court by the STF has the potential to minimize gender stereotypes against victims. For that, the deductive method was used and bibliographic and documentary sources were consulted. The research structure considered the historical evolution of the role of women in society, as well as legislative and jurisprudential changes, aiming to understand the phenomena of discrimination and gender violence and identify the reflexes of the recent decision, as well as the problems that still need to be addressed.
