Trata-se a presente monografia de um estudo, nos ordenamentos jurídicos brasileiro e português, das respectivamente denominadas uniões estáveis e uniões de facto. Por meio de uma pesquisa bibliográfica exploratória e dos métodos comparativo e analítico, tem por objetivo compreender o instituto no que toca à sua legalização, tratamento constitucional, natureza jurídica, noção jurídica, prova e seus efeitos patrimoniais; esses na sua constância e quando do término, seja ele por vontade, casamento ...
Trata-se a presente monografia de um estudo, nos ordenamentos jurídicos brasileiro e português, das respectivamente denominadas uniões estáveis e uniões de facto. Por meio de uma pesquisa bibliográfica exploratória e dos métodos comparativo e analítico, tem por objetivo compreender o instituto no que toca à sua legalização, tratamento constitucional, natureza jurídica, noção jurídica, prova e seus efeitos patrimoniais; esses na sua constância e quando do término, seja ele por vontade, casamento, ou decorrente do falecimento de um dos seus membros. Para tal, o trabalho encontra-se estruturado em duas partes, iniciando-se pelo tratamento dado pelo Direito Brasileiro e, logo após, pelo Direito Português. Concluiu-se que, embora existam há bastante tempo nas sociedades, as referidas uniões ainda possuem lacunas em suas normatizações e questões sem entendimento unânime na doutrina e na jurisprudência. Contudo, no Brasil se denota que a união estável, para além de ser consagrada constitucionalmente como uma espécie de família, sua regulação e efeitos tendem a se aproximarem do matrimônio, conferindo-lhe uma maior proteção jurídica. Em Portugal, por sua vez, a união de facto gera esparsos direitos e é tratada de maneira bastante diversa que o casamento, sendo sequer aceita de maneira geral como uma relação de família. ...

The present monograph is a study in the Brazilian and Portuguese legal systems, respectively, called stable unions and de facto unions. The present monograph is a study in the Brazilian and Portuguese legal systems, respectively, called stable unions and de facto unions. Through exploratory bibliographic research and comparative and analytical methods, it aims to understand the institute concerning its legalization, constitutional treatment and legal nature, legal notion, proof, and patrimonial effects, these in their constancy and when they end, whether by marriage, or due to the death of one of its members. For this purpose, the work is structured in two parts, starting with the treatment given by the Brazilian Law and, after, by the Portuguese Law. It was concluded that, although they have existed for a long time in societies, the aforementioned unions still have gaps in their norms and issues without unanimous understanding in doctrine and jurisprudence. However, in Brazil, it is noted that the stable union, in addition to being constitutionally enshrined as a kind of family, its regulation and effects tend to approximate marriage, giving it more legal protection. On the other hand, in Portugal, the de facto union generates sparse rights and is treated quite differently from marriage, being even generally accepted as a family relationship. ...
