Direito ao nome : nome social enquanto direito de personalidade

Abstract

O presente trabalho versa acerca do nome social, figura própria do ordenamento jurídico brasileiro, buscando evidenciar se essa solução improvisada proposta cumpre seu papel de estender o direito ao nome às pessoas trans. Trata-se de monografia de conclusão de curso apresentada na Faculdade de Direito da Universidade Federal do Rio Grande do Sul – UFRGS como requisito parcial à obtenção do grau de Bacharel em Ciências Jurídicas e Sociais. A realização do trabalho dá-se através dos métodos dedutivo e hipotético-dedutivo: aquele, na medida em que se utiliza de uma cadeia de raciocínio descendente, partindo-se da análise geral para a particular; este, visto que é identificado um problema para o qual é proposta uma solução, ainda que de forma conjectural. Ato contínuo, realiza-se um estudo acerca do tratamento do nome social pelo Tribunal de Justiça do Rio Grande do Sul, analisando-se a jurisprudência, bem como a visão mais geral desse instituto dada por entendimentos consolidados do Superior Tribunal de Justiça, sendo verificada a indispensabilidade de o tema ser tratado de forma mais sensível e atenta pelo Poder Judiciário. Com a estudo das temáticas que permeiam o nome social, especialmente a partir do Decreto n.º 8.727/2016, é evidenciada a necessidade de tratá-lo como um instituto passageiro, devendo ser conquistada a efetiva possibilidade de alteração do nome civil às pessoas trans. A pesquisa fica limitada à atualidade do nome social e do próprio crescimento das temáticas concernentes à identificação de gênero, sendo indispensável a sua atualização constante. Ao final, pretende-se demonstrar a imprescindibilidade de se alcançar a inclusão da possibilidade de alteração administrativa do nome civil por pessoas trans na Lei de Registros Públicos (Lei n.º 6.015/1973).

The present paper deals with the social name, a proper figure of the Brazilian legal system, seeking to show whether this proposed improvised solution fulfills its role of extending the right to a name to transgender people. This is a conclusion work monography presented at the Federal University of Rio Grande do Sul, College of Law, as partial requirement for obtaining the title of Bachelor of Laws. The work is carried out using the deductive and hypothetical-deductive methods: the former, as it uses a chain of descending reasoning, starting from the general analysis to the particular; the latter, due to the identification of a problem for which a solution is proposed, albeit in a conjectural way. Next, is studied the treatment of the social name by the Court of Rio Grande do Sul, analyzing its jurisprudence, as well as the more general view of this institute given by consolidated understandings of the Superior Court of Justice, being verified the indispensability of the theme being treated in a more sensitive and attentive way by the Judiciary. Through the study of the themes that permeate the social name, especially from Decree No. 8.727/2016, it is evidenced the need to treat it as a temporary institute, and the effective possibility of changing the civil name for trans people must be conquered. The research is limited to the actuality of the social name and the progress of the themes concerning gender identification, so its constant updating is indispensable. Finally, this paper attempts to demonstrate the need to achieve the inclusion of the possibility of administrative change of civil name by transgender people in the Public Records Law (Law No. 6.015/1973).
