Análise dos mecanismos de proteção aos direitos de autor de obras fotográficas previstos pelo ordenamento jurídico brasileiro à luz das evoluções tecnológicas

Abstract

A evolução das tecnologias, evidenciada, principalmente, pelo surgimento de aparelhos eletrônicos ultramodernos e pelo surgimento da rede mundial de computadores, mudou significativamente o modo de criação das obras fotográficas, o seu papel na sociedade e a interação estabelecida entre os indivíduos e essa criação intelectual. No direito brasileiro, a entrada em vigor da Lei nº 9.610/1998 (Lei de Direitos Autorais) é contemporânea ao início das transformações acima referidas, de forma que este trabalho tem por fim perquirir até que ponto os mecanismos de proteção de direito autoral previstos pelo ordenamento jurídico brasileiro são eficientes à adequada tutela das obras fotográficas no contexto das mudanças tecnológicas vivenciadas pela sociedade. Assim, verificou-se a ineficácia parcial das disposições da lei no contexto da sociedade contemporânea, porquanto rígida a legislação em razão do contexto em que elaborada, resultando, então, em especial desproteção às obras fotográficas no ambiente virtual. Conquanto a reforma legislativa seja uma solução a longo prazo, parece ser ela, em conjunto com as licenças públicas de uso, em observância à maleabilidade do instituto jurídico norte-americano do fair use e em análise crítica à Diretiva (UE) 2019/790, o caminho a ser percorrido para a construção de um aparato jurídico coeso capaz de servir melhor à questão da proteção das obras fotográficas na sociedade contemporânea.

The technological evolution, mainly evidenced by the development of ultramodern electronic devices and by the development of the internet, has significantly changed the way in which photographic works are created, their role in society and human beings’ interaction with this intellectual creation. In Brazil, the entry into force of Act 9.610/1998 (Brazilian Copyright Act) is contemporary to the beginning of the aforementioned transformations, thus this work aims to investigate to what extent the mechanisms of copyright protection provided by the Brazilian legal system are efficient for the adequate protection of photographic works in the context of technological evolutions experienced by society. Thus, given the rigidness of the Brazilian Copyright Act, due to the context in which it was drafted, it was found that the provisions of the law are partially ineffective in contemporary society, resulting, therefore, in a special lack of protection for photographic works in the virtual environment. While legislative reform is a long-term solution, it appears to be it, along with public copyright licenses, in compliance with the malleability of the fair use doctrine and in a critical analysis of Directive (EU) 2019/790, the path to be followed for the construction of a cohesive legal apparatus capable of better serving the issue of the protection of photographic works in contemporary society.
