A responsabilidade civil pelos atos dos filhos menores no ambiente familiar e escolar

Abstract

O presente trabalho tem como escopo a análise da Responsabilidade Civil dos pais perante os atos ilícitos cometidos por seus filhos, partindo do método dedutivo e empregando análise doutrinária e jurisprudencial sobre o tema. A monografia foi dividida em dois capítulos. Na primeira parte abordar-se-á aspectos gerais da responsabilidade civil por fato de outrem, para entendermos a relação fundamental para o desenvolvimento do trabalho: a obrigação de indenizar dos pais em relação aos ilícitos cometidos pelos filhos menores. Já na segunda parte a análise será exclusivamente sobre a relação jurídica entre a responsabilidade civil dos pais e a prática de bullying nas escolas (ou mesmo no meio virtual).

The present study has as scope the analysis of the parent’s liability before the illicit acts committed by their children, from the deductive method and using the doctrinal and jurisprudential analysis about the subject. The monograph consists of two chapters. In the first part will be considered general aspects of the third-party liability, so that can be understood the fundamental relation to the study: the parents’ obligation to indemnify before the illicit acts committed by their children. In the second part the analysis will be exclusively about the legal relationship between the liability of the parents and the practice of bullying in the schools (or even in the virtual space).
