Violência sexual contra crianças e adolescentes : fatores jurídicos-sociais e realidade brasileira desde uma perspectiva histórica

Abstract

A criança e o adolescente merecem especial cuidado e possuem uma gama de direitos previstos na Constituição Federal de 1988 e no Estatuto da Criança e do Adolescente; contudo, não há real efetivação de todos esses direitos. Entre as violências contra eles mais cometidas no Brasil, estão as agressões sexuais, que costumam ser combatidas e resolvidas por uma ótica individual. Deste modo, o presente trabalho objetiva responder o seguinte problema: existem de fatores provenientes de ordem estrutural e social que afetem a perpetração de crimes de natureza sexual contra crianças e adolescentes, e são as atuais políticas público-criminais brasileiras suficientes para combater à perpetuação dessa espécie de violência e a mitigar suas consequências? Nesse sentido, utiliza-se a metodologia hipotético-dedutiva e a abordagem quali-quantitativa a partir de revisão bibliográfica e dados secundários para entender quais os fatores estruturais relacionados ao abuso sexual contra infantes e jovens. Conclui-se, visando o combate à violência sexual infanto-juvenil de uma perspectiva coletiva e multidisciplinar, a necessidade de aprimoramento da coleta e de integração de registros sobre esses crimes, a promoção de políticas público-criminais de conscientização, atendimento e tratamento das vítimas e o enfrentamento das desigualdades sociais.

Children and adolescents deserve special care and have a range of rights provided for in the Federal Constitution of 1988 and the Statute of Child and Adolescent; however, there is no real enforcement of all those rights. Among the most common forms of violence committed against them in Brazil are sexual assaults, which are usually fought and solved from an individual perspective. Thus, the present work aims to answer the following question: are there structural and social factors that affect the perpetration of crimes of a sexual nature against children and adolescents, and are the current Brazilian public-criminal policies sufficient to combat the perpetuation of this kind of violence and to mitigate its consequences? In this sense, the hypothetical-deductive methodology and the qualitative-quantitative approach are used based on literature review and secondary data to understand which structural factors are related to sexual abuse against children and adolescents. It is concluded, to combat children and juvenile sexual violence from a collective and multidisciplinary perspective, the need to improve the gathering and the integration of records on these crimes, the promotion of public-criminal policies to raise awareness, care and treatment of victims, and the confrontation of social inequalities.
