Fake news e direito : algumas considerações

Abstract

O direito tem se apropriado, aos poucos, do tema das fake news. Busca-se neste trabalho acadêmico, para além do viés interpretativo que inicialmente dominou a temática na universidade – e que tratava da influência desses fenômenos comunicacionais na democracia –, tratar do tema do ponto de vista filosófico e prático – isto é, para a prática jurisdicional. Com um ensaio, problematiza-se então questões associadas à contemporaneidade das relações sociais e de questões jurídicas relacionadas a fake news. Visitam-se os diferentes estatutos de verdade que se apresentam quando do exercício da tutela jurisdicional, perguntando-se filosoficamente qual o lugar das fake news. Por fim, questiona se sobre como pensar fake news frente a direitos de personalidade, seara na qual esse tipo de fenômeno parece trazer demandas mais cotidianas – e no qual tecnologias como deep fakes proporcionam perguntas importantes sobre o futuro da intimidade.

Fake news has been gradually appropriated by the academic debates on law. In addition to the interpretative bias that initially dominated the theme at the university – and which dealt with the influence of these communicational phenomena on democracy –, this academic work seeks to address the issue from a philosophical and practical point of view – that is, for the jurisdictional practice. As an essay, issues associated with the contemporaneity of social relations and legal issues related to fake news are then problematized. The different statutes of truth that are presented when exercising jurisdictional protection are visited, philosophically asking what is the place of fake news. Finally, it asks how to think about fake news in the face of personality rights, a field in which this type of phenomenon seems to bring everyday demands – and in which technologies such as deep fakes provide fundamental questions about the future of intimacy.
