Contribuições para uma análise crítica da “reforma” trabalhista

Abstract

Este trabalho visa analisar de forma crítica a reforma trabalhista instituída em 11 de novembro de 2017, instrumentalizada pela Lei 13.467/17 e seus reais impactos na vida dos trabalhadores e trabalhadoras brasileiros. A nova legislação, originada em uma conjuntura de hegemonia neoliberal, após um golpe de estado sofrido pela presidenta Dilma Rousseff, foi supostamente desenvolvida com a finalidade de gerar mais empregos no mercado de trabalho brasileiro. Diante disso, realizou-se na presente monografia uma pesquisa qualitativa, adotando-se o raciocínio dedutivo, através de pesquisa bibliográfica e documental, a fim de demonstrar se a reforma trabalhista foi, de fato, instituída objetivando a criação de postos de emprego e se, após quase 5 anos de sua implementação, esta obteve êxito no suposto objetivo de sua criação. A estrutura da pesquisa considerou os contextos históricos que levaram à criação da referida Lei, os cenários políticos que incentivaram o argumento de necessidade de sua implementação e os trâmites jurídicos e políticos até o momento de sua concretização. Foi considerado também o panorama pós-reforma, verificando as alterações realizadas, especialmente, no que diz respeito aos novos formatos de contratação. Ainda, foram realizadas breves considerações acerca da crise sanitária ocasionada pela COVID-19, para, então, analisar os impactos da reforma trabalhista em nível de empregabilidade e relações trabalhistas no país.

This monograph aims to critically analyze the labor reform instituted on November 11th, 2017, instrumentalized by the Law 13.467/17 and its real impacts on the lives of Brazilian workers. The new legislation, originated in a context of neoliberal hegemony, after a coup suffered by President Dilma Rousseff, was supposedly developed with the aim of generating more jobs in the Brazilian labor market. In view of this, a qualitative research was carried out in this monograph, adopting deductive reasoning, through bibliographic and documentary research, in order to demonstrate whether the labor reform was, in fact, instituted aiming at the creation of jobs and if, after almost 5 years of its implementation, it was successful in the supposed objective of its creation. The research structure considered the historical contexts that led to the creation of the aforementioned Law, the political scenarios that encouraged the argument of the need for its implementation and the legal and political procedures until the moment of its implementation. The post-reform scenario was also considered, verifying the changes made, especially with regard to the new hiring formats. Also, brief considerations were made about the health crisis caused by COVID-19, to then analyze the impacts of the labor reform in terms of employability and labor relations in the country.
