O acordo de seguridade social ou segurança social entre Brasil e Portugal : um estudo comparado dos benefícios previdenciários nos dois países

Abstract

Durante todo o século XX e início do século XXI, muitas foram as iniciativas legislativas e os acertos e desacertos dos governos em buscar construir seus modernos sistemas de previdência social. Por meio da análise do acordo internacional entre Brasil e Portugal em matéria de previdência social, é possível observar como os sistemas de previdência social foram estruturados internamente nesses dois Estados. Ao se comparar os benefícios previdenciários previstos nesse acordo, percebe-se que, apesar dessa complexidade legislativa, existem semelhanças significativas entre os sistemas de previdência social de Brasil e Portugal. Podese entender que essas semelhanças são resultado da cooperação dos Estados no sistema internacional, especialmente quando estes Estados compartilham valores e conhecimentos na área da previdência social. A existência de organizações internacionais, tanto em nível global, como a Organização Internacional do Trabalho (OIT), quanto em nível regional, como a Organização Ibero-americana de Seguridade Social (OISS), facilita essa cooperação, na medida em que constitui espaço destinado ao intercâmbio de experiências acerca dos sistemas de segurança social implantados por esses Estados. O objetivo geral do trabalho é entender se a cooperação entre os Estados no âmbito internacional em matéria de previdência social foi eficaz no sentido de facilitar a convergência dos sistemas de previdência social elaborados por seu ordenamento jurídico interno e, dessa maneira, ser possível afirmar que existe um regime internacional ou, pelo menos, uma governança global em matéria de previdência social.

Throughout the 20th century and the beginning of the 21st century, there were many legislative initiatives, as well as the successes and mistakes of governments aiming to construct their modern systems of social security. By analysing the international agreement between Brazil and Portugal on social security, it is possible to observe how the social security systems were structured internally in these two States. When comparing the social security benefits provided for in this agreement, it is clear that, despite this legislative complexity, there are significant similarities between the social security systems of Brazil and Portugal. It can be understood that these similarities are the result of the cooperation of States in the international system, especially when these States share values and knowledge in the area of social security. The existence of international organizations, both at a global level, such as the International Labor Organization (ILO), and at a regional level, such as the IberoAmerican Social Security Organization (OISS), facilitates this cooperation, insofar as it constitutes a space for the exchange of experiences on the social security systems implemented by these States. The general objective of this research is to understand if the cooperation between the States in the international system on social security was effective in the sense of facilitating the convergence of the social security systems elaborated by their domestic legal system and, in this way, it is possible to affirm that there is an international regime or, at least, global governance on social security.
