Ruth Bader Ginsburg : uma vida dedicada à igualdade

Abstract

Buscou-se analisar o trabalho desempenhado pela jurista norte-americana Ruth Bader Ginsburg enquanto advogada pelos direitos das mulheres, visando a construção de uma sociedade mais justa e inclusiva, superando regramentos estaduais e precedentes que endossavam as discriminações, ao manter uma linha de raciocínio atrasada que mantinha as mulheres presas a um status de inferioridade. Para tanto, partiu-se do desenvolvimento do efeito vinculativo dos precedentes no Common Law, discorrendo acerca dos instrumentos de superação destes, seguindo para uma contextualização histórica da luta pela igualdade entre os sexos, passando por pontos cruciais ao desenvolvimento do imaginário coletivo, de que às mulheres deveria ser garantido o mesmo tratamento diante da lei, como a proposta de emenda constitucional Equal Rights Amendment, e a busca da igualdade através do caminho indireto, ou seja, a busca pela classificação de gênero como uma classificação de suspeito, para somente então adentrar nas especificidades dos casos. Os casos examinados no presente trabalho tratam do combate à promoção da política nefasta de considerar as mulheres o sexo frágil, de maneira que precisavam ser protegidas, cuja consequência foi a implementação de regras e a manifestação de opiniões que, sob o véu da proteção, aprisionavam as mulheres, representando obstáculos na disputa por vagas em empregos melhores, na obtenção de benefícios e na plena realização da sua cidadania. Por fim, conclui-se acerca da extrema importância das colocações da advogada, que através de litígios judiciais angariou mais espaço para as mulheres na sociedade americana.

The present study sought to analyze the work performed by the American jurist Ruth Bader Ginsburg as a lawyer for women's rights, aiming at building a more just and inclusive society, overcoming state regulations and precedents that endorsed discrimination, while maintaining a backward line of reasoning that kept women trapped in an inferior status. To do so, the work started by discussing the development of the binding effect of precedents in Common Law, and the instruments for overcoming them, moving on to a historical contextualization of the struggle for equality between sexes, passing through crucial points for the development of the social imaginary from which women should be guaranteed the same treatment under the law as to men, as the proposed Equal Rights Amendment to the United States constitution, and the search for equality through an indirect path, that is, a search for gender classification as a suspect classification, only then to get into the specifics of the cases. The cases hereby examined dealt with the fight against the promotion of the harmful policy of considering women as a weaker sex, in a way that they needed to be protected, the consequence of which was the implementation of rules and the expression of opinions that, under the veil of protection, limited women’s freedom, promoting obstacles for them in the search for better jobs, in obtaining state benefits and in the fruition of their full citizenship. At last, this paper concludes about the extreme importance of the lawyer's positions, who, through legal litigation, gained more space for women in American society.
